Melissa of Wheaton MD writes (7/3/01):
On June 8, 2001, I purchased a 2001 Nissan Altima from Gaithersburg Nissan. I am a recent college graduate and I was interested in Nissan's recent graduate discount program. According to my sales consultant, Herman Verdine and the financial manager Marilyn Luke, I was qualified for the program and I was approved for credit.

My contract states that my monthly payments would be $388 per month. After having the car for three weeks, I received a call from my sales consultant and the new financial manager, Mr. Darnell Gray. He rudely stated that I need to come in as soon as possible, because Nissan did not approve me for the amount stated on my contract.

I had three options, to get a co-signer, return the car or pay a higher interest rate, which would increase my payments to $477 a month. I feel that I have been misled and I should not have to do any of the three options listed by Mr. Gray. I would like to keep the car and pay what was the original agreement.

I am not financially ready to make payments of $477 per month.I am required to have a reliable car and a Nissan Altima is a reliable car to me.

This is what is known as "spot delivery" and it is a very unsavory practice. It may also be a violation of one or more consumer fraud laws. Melissa should contact her state or county consumer protection office.
