Ernest of San Antonio writes (9/1/01):
Went to Ingram Park Nissan to get an oil change for our vehicle, decided to window shop for new vehicle. A salesman (Reynaldo) approached us asking if he could show us any of the vehicles, not having any other means of access we agreed.

We chose a particular vehicle and asked what it would take to purchase. He said first there would be a test drive to make sure we liked the vehicle and then we would discuss the financing. We began the negotiating process. We were first asked what payments we would like to to be making on the vehicle and if we were willing to make some sort of deposit; we stated our budget was so that we could see ourselves making $450 payments a month and we would be wlling to give five hundred dollars down.

Ultimately we agreed on an MSRP of $23,699, our deposit would be one of our vehicles ($300 cash value + $700 cash allowance) plus $1500 for a grand total of $2500. They asked us to write the check out to prove we were serious about our purchase, we did so. They began to look for a loan, returning numerous times with various monthly quotes; rejecting several we came to $461 a/month for 5yrs.

Sensing I was a little relunctant the salesman, Noel, asked for a little help stating that they had found us an interest rate under 8% giving us a monthly payment close to our target. Still wary I asked if we had been approved and Noel said yes. My wife and I discussed, agreed and signed documents stating since they had found us the monthly and interest rate we were looking for we would go ahead and purchase the vehicle that day.

The general manager approved everything and we were sent to finance. We rushed thru several documents agreeing newly to the interest rate and monthly payments and finally our purchase order. The finance woman stated that when our payment book would arrive our payments would be $461.87 a month and congratulated us on the purchase of our new vehicle. The thing is since we had had our two year old daughter with us at the the time I stated several times that things were going a little fast that I needed to take her home so we could change her, everyone was becoming a little agitated and my daughter at times unmanageable. She hadn`t eaten needed a diaper change etc.

Consequently a few days later they called us stating the finance was not approved at the rate they gave us that it was now at 13% raising our payments to $511.

Sounds like a spot delivery. Reynaldo should contact a local attorney or the local consumer protection agency.
