Diana of Indianapolis, IN July 25, 2009

I have paid my bill on line for the past two years but last month I tried to pay my bill on line and it wouldn't let me. I tried again a couple of days later. On the date that I called Capital One to find out what the problem is with their payment site I was still current with my payments. However, when I called the customer service rep. said she would be glad to take my payment over the phone and not charge me a fee. She told me that I would be charged a late payment even though I protested because I was not late. The payment site says that if you make your payment after 3 p.m. it will post the following business day. But I tried to explain to them that I had been attempting to pay on line as I did every month but she said, wait until next month and then call when you receive your next statement in the mail.

Well, I did call and I was told that my payment had more than doubled because I was being charged a late fee and because the late fee put me over my limit that I was also being charged for a over the limit fee plus the monthly member fee. I attemtpted to explain to them what had happened and they agreed to take the over the limit fee and the late fee off of the bill the following month but this month I would have to pay more than the double payment.

I explained to them that I am on social security disability and that I my one check has to pay all of my bills for the month. One fellow I spoke with, a Walter who said he was in another country was very smart with me and told me that I needed to start paying my bill by mail. I explained to him that the previous month when I had tried to pay my bill on line their technician who I was later transferred to told there was a glitch in the system at that time. But he said he didn't care and I should start paying my bills by mail. I pay all of my bills on line and this is the first time I have ever had this problem.

This company is calling my work number. I don't have a Capital One card, but I suspect that they are looking for a relative of mine that has one. I have called twice and asked Capital One to cease and desist calling my work number especially since I am not the person that they are looking for. Capital One refuses to do so. They are stating that only the cardholder can ask them to stop calling me. This is my place of employment and I should not be receiving these type calls at work. Please tell me what my rights are under the law.

Dorothy of Mead, WA July 24, 2009

My card jumped from 5% to 15% in June.I called and asked why the rate jump? They said I should have received a letter in the mail, with an option to close account and pay off balance at previous rate. The close date for that option was April ??. I do not recall getting any type of letter from them in the previous months. What's in my wallet? Nothing, except a big debt to pay down at a high rate!!

Valerie of Fremont, IA July 23, 2009

I have had a Capital One credit card for many years and did not use it until my husband was layed off from work and we got a little bit behind. They sent me check after check to use on "whatever we needed." Sadly, I did use the checks to pay the house payment a couple of months in a row. Then down the road I notice a HUGE rate increase. I called them and they stated they could do that, even though I had made my payment on time each month, actually paying more than the minimum payment.

Then one month my bill had slid under my car seat and did not realize I had not paid it until I received a phone call from a collection agency stating my bill was 3 days late, yes only 3 days. The harassment started from there. The gentleman on the phone tried to tell me that the month before I had not made my full payment. Then I was very upset and asked to speak to a supervisor and got a lady by the name of Davia. She stated that the first gentleman I talked to was incorrect, and that I was just 3 days late on July's payment. When I asked why it was with a collection agency, when in the past I had always made my payments on time, and she stated that even 1 day late and it goes to the collection agency.

Then it gets better. Then she starts harassing me telling me I only pay the minimum payment each month and that is not enough. I told her that was none of her business how much I paid as long as I was making my minimum payment, and she said it was her business and that I needed to pay more than the minimum payment every month. Then she went on to demand I pay the payment I was 3 days behind on, the next month's payment that was not due for 25 days, and also a late fee. She said she would remove the late fee if I did this over the phone with her. I said I would pay this online because I wanted print out proof that this had been paid as I did not trust their company the least bit. She agreed to this and I have a print out with all the information, her name, etc. We will see if she really take the late fee off. I know 3 other people that have had this same experience. I will be getting out of this card as soon as possible!

Curtis of Winter Haven, FL July 23, 2009

Credit Card interest rate increased from 9.40% to 17.90% for no reason other than to take advantage of excellent customers to help pay the bills of people with poor credit. My FICO average is 790 (average from all three reporting agencies).

J. of PEYTON, CO July 22, 2009

I know this is a fruitless point, but I want to go on record as complaining about Capital One jumping my credit card interest rate from 13% to 29%. My credit rating is above 725. I have never missed a payment. When contacted, the customer service MANAGER suggested bankruptcy as an answer. Obviously, we are not using the card anymore and are frantically looking for ways to get out from under this obligation.

Martha of Red Cloud, NE July 21, 2009

During a time of a 6-year drought, we did accumulate a large credit card debt in order to try to keep our farm/ranch in business. When my husband lost his job on top of that, we did get behind on our debt. By the time that I was trying contact all our creditors, I had forgotten about Capital One because we were no longer receiving bills or any type of correspondence from them. Until the first part of June when we received a letter from an attorney's office saying they had now taken over as a collection agency. In an exhaustive effort to determine what had happened, Capital One had placed(they did this, not us) a cease-and-desist order on our account and now say they can not do anything about this. We are trying to work with them as well as the collection attoryneys, but our income is most definiteyly limited and time is quickly running out!

joseph of middletown, NJ July 21, 2009

capital one sent me a statement, which included an interest amount, on a balance when I paid the prior statement in full. Their reason was that there was a balance on the account after their cut off date.

Ron of Atlanta, GA July 21, 2009

Capitol One increased my interest rate from 7.90% to 17.90% in May of 2009. I never received their notice of rate increase despite having received every statement this year without issue. I moved a large balance from another credit card before the change in terms took effect, yet Capitol One is refusing to freeze my terms and close the account citing that I had my chance. I pointed out that I hadn't received their letter and no statement before or since has indicated the change in terms with the exception of the Finance Charges section AFTER the change in terms had taken effect. She simply said that Capitol One would not change the interest rate and asked if she could help me with something else. I asked for a supervisor and the supervisor repeated the same thing. She said that there was no one I could speak to about it beyond her. She gave me the address to mail consumer complaints to and told me to have a nice day.

Jeni of Longmont, CO July 21, 2009

So I see that I'm not the only one that had an interest rate increase from 7.9% to 17.9%. After I found out about the rate increase I quickly transferred my balance to another card. What is interesting is that after having my Capital One card completely paid off I received a 27.03 finance charge. According to Oscar, the customer service rep, if you do not pay your balance off in full for two consecutive months you will then receive a 27.00 finance charge per month (unless you pay off your balance in full for two consecutive months). This finance charge is shown on my statement as accrued interest to 1,778.17 in purchases (specifically listed as Balance rate applied to 1,778.17). Since there were no purchases made, I am deeply disturbed that they are adding this 27.03 charge under the guise of interest applied to a ficticious balance on the card.
