Gay of HICKORY CREEK, TX May 18, 2009

Bank of America's has sent me mortgage payment coupons since 1998 stating:

Payment Due Date mm/01/yyyy Regular Payment x,xxx.xx optional propducts 0.00 Total Amount Due x,xxx.xx After mm/16/yy add late fee 39.47 Total Due after mm/16/yy (is x,xxx.xx + 39.47)x,x39.47

They have assessed hundreds of dollars to my escrow account on the 16th of the month not after the 16th. I was told that research was done on the list of late charges that I had questioned and that all of the late fees were assessed correctly. When I asked about the first late charge on the list they repeatedly hung up the phone on me. I had been trying to check over my loan history with them since January. On March 25th,I faxed 4 pages with details on all of the questionable late fees asking for an answer by April 25th. I have sat at my locale branch and on the phone speaking to at least 10 different people in the mortgage branch and never spoke to anyone about the first late fee. The branch told me I would never see any of the money.

B of A took 592.05 for late charges paid on the 16th plus an added 10 to 15 if I called the payment in so that it would not be late. I have spent months going over my checking account, phone bills and loan. How can they get away with this? I had to pay 2 months and 11 days of interest while I waited for their "research" when I move my loan. If I could only charge them for my time .

I scheduled a payment on line with Country Wide for the day that Bank of America took over.. when they converted there systems the payment did not post. I called had them take the payment and tried to talk to customer service I did not want to get a 30 day late when I had schedule the payment after being told I could not talk to a supervisor and having to argue with the rep to put me through I was told that they would investigate and call me back now a week later I have not gotten a call but I have received a letter from them stating since my payment was 30 days late I am now in danger of them taking further action against me.. I need to call them to set up a payment arrangements... I wanted to refi and now will not be able to.

Tammy of austell, GA May 4, 2009

I contacted Bank of America on May 4 2009 about Presidents Obama new HARP program. I spoke with a resprensitive about refinancing my home under the home afforable program. I was told that i did not qualify for the program because of additional insurance that was purchase on my home by Fannie Mae, i ask for an explantation for this because i do not have an pmi nor do i have an escrow account with this loan. I was transferred to another custormer representive who told me that the information given to me by the first reprensitive was false because i did not have an escrow account or a pmi. I was transferred three times and was hung up on. So i called back and spoke with nother representive, she then told me that i didnt qualify because of my loan wasnt backed up by Fannie Mae. this was also false,

i was then transferred to T. Sober at ext 5491 who told me i didnt qualify because of insurance that was purchased by fannie mae. I requested to have a copy of the documentation showing when that insurance was purchased and why it was purchased she denied me the information and told me that she could not help me or give me any information obtaining to the extra insurance purchased. I then called Fannie Mae and explained the situation about me not having an pmi or an escrow account, a Fannie Mae representive explained to me that it didnt make any sense for them to stating that i had additional insurance purchased on my property when i didnt have an pmi or an escrow account.

I then called Bank of america back and spoke with T. Sober at ext 5491 and i spoke with her supervisor at ext 5180 and they both were very rude and told me i did not qualify and they would not give me an explanation in light of me explaning to them about what Fannie Mae had stated to me about the no pmi and no esrow account.

Shaun at ext 5180 hung up in my face and would not give me an explantation for denying my HARP loan, this has cause me great heartache and pain to be treated like this,to be denied something set up by our president that i qualify for. I also asked Shaun what he was going to do about the mistake and he told me basically nuthing.I am single mother of three and my loan is not in default. The way i was treated was uncalled for. I know that they record the conversation. Bank of America needs to be investigated for fraud and giving false information to consumers

I refinanced my house. BOA sent a notary to the house in Colorado (BOA is in CA)and she did not know anything about the loan documents except where to sign. The Settlement statement said I was owed 948.08 at closing but instead I was told to pay 1387.75 to a company called service link. I have ask for a correct settlement statement showing why I had to pay instead of getting cash back and where the 400 that BOA charges upfront was applied but BOA will not respond. They include a clarity commitment in the loan papers which they failed to uphold. Taking money without explaining why has to be illegal.

James of Phoenix, AZ May 11, 2009

On Thursday, April 23, 2009. We received a letter from AAA Homeowners Insurance that stated that our premium due on May 01, 2009 had not been paid yet. We called AAA to check on our premium and asked what should we do, we were told to wait until May 01, 2009 and check back with AAA find out if the premium had been paid. I then went to Bank of America's website and looked at our account and it showed that BofA had taken 413.00 out of our escrow account (on Monday, April 13, 2009) to pay our homeowners insurance. We then called AAA on 3 different days to check and see if our homeowners insurance had been paid (it had not). Then Monday, May 04, 2009 my wife finally called AAA again and someone named Phil got us on a 3 way phone hook up to a lady named Jessie at BofA my wife told Jessie about our problem and that the problem might be because of the policy number that BofA had on their website, BofA had our policy number as ...672 and the check was sent to ACA INSURANCE COMPANY when our policy number is ...432 and is payable to AAA INSURANCE COMPANY. Jessie from BofA then asked about 2 others policy holders and was told by AAA that that those 2 policy holders Insurance had not been paid as of May 04, 2009. Jessie of Bofa then did some checking and said That BoA had issued a check for 56,378 that they couldn't find and they didn't know where the check was. But that they would put a check for 413.00 in the overnight mail to pay our for our homeowners insurance. And as of this moment at 0900 hours May 11, 2009 my wife is on another 3 way conference call with Phil of AAA and Crystal from BofA trying to resolve the above issue and Crystal has promised that a check will be sent overnight to handle our homeowners insurance problem (this is the same thing we got from Jessie a week ago on Monday, May 04, 2009. And no check has been sent to AAA INSURANCE COMPANY). Today Monday, May 11, 2009 at15.30 hours we received our mail and guess what, there was as a letter from AAA INSURANCE COMPANY telling us that our homeowners policy has expired as of 12:01 AM on May 01, 2009 Bank of America took 413.00 out of our escrow account on April 13, 2009 to pay our homeowners insurance. And they seem reluctant to either pay our insurance or return the money to our account.

Jonathan of Jupiter, FL May 10, 2009

Over the last 6 months I have received on 4 different occassions letters from the bank stating that I do not have acceptable coverage on my attached townhome. I have two insurance policies, one for the content and one for the exterior which is maintained by the HOA since I live in an attached unit. I have submitted the required information or had the insurance agent for the HOA contact the bank and each time the bank has removed the insurance. But now they have put the insurance back on my home again. This is taking up considerable time and effort as well as causing me a great amount of fustration! This obstacle is taking up part of the work day on numerous occassions.

Misti of Duncan, SC May 7, 2009

I applied for a refinance of mortgage 1-16-09. It has been four months and I still have not closed on the loan. Bank of America can not provide any reason for this delay other than they are busy and don't have enough staff. I paid the 400.00 application fee initially, was approved, provided all requested documentation. I have received threatening letters from the bank on several occasions stating "you must close by __ date or we can not refinance," "insurance regulations have changed and you must close by __ or we can not close this loan, etc." I have not control over their inability to close the loan and have only done everything asked of me during this process.

S. of Menlo Park, CA May 6, 2009

In Dec. 2008 I applied for a refinace loan (185K with 4.85% with 1.8 points). Points were increased to nearly 5 points during a lengthy, sordid 'negotiations.' Just received a note that loan will not be granted. I paid 400 application fee, which the Bank of America refuses to refund. Dealing with loan officers were traumatic; they are unfriendly, mean and unpleasant to deal with. My advise: stay away from Band of A.

I have a 30yr fix fannie mae flex loan through B/A. My income has been reduced over 2,000.00 and living on SSI my husband works but in two months we will no longer be able to afford our home. B/A has been giving the run around and now loan officer told me I don't qualify for the Obama HASP home modification because I pay PMI in my loan. She already led me to believe I got an Acorn loan since I was approved and she did not give me an acorn loan. I filed a complaint to her boss and he is also not returning my calls. I qualify for the HASP Obama bill but for whatever reason I am being told something I have never heard.

I need help. We have execellent credit, never been late in our mortgage our home lost value and I got it over a year ago. My income was reduced drastically I am disabled and unable to get more income. With this economy my husband is not guaranteed overtime. Our mortgage is over 2,800.00 plus all of the bills. I am going to lose it in the next two months if I don't get some help. Can someone please guide me or help me.
