Three years ago I applied for a refinancing and got it through CountryWide/Full Spectrum. I refinanced to take advantage of the new interest rate and to remove the other person's name that appeared on the mortgage papers. This property was owned by myself and another person, this property is a condo, and its a property in the Bronx. During the closing 3 years ago, the other party attended the closing at the office designated by CountryWide and signed all the required paperwork to effectuate a quit claim deed. An attorney was present and so was the notary public person. I became the sole owner of this property. (so I thought) 

I received my check from CountryWide and started making monthly mortgage payments. Over a month ago, I decided to apply for another refinancing, using CountryWide, my mortgage company, and started the process. I paid out of pocket 300.00 for the appraisal. The propery was appraised at 100,000- I have a balance on my mortgage of 46,000. I was quoted an interest rate of 5.8%, which is actualy the current interest rate I have. This time around I requested a 30 year fixed. I currently have a 15 year fixed with 12 years to go to pay it in full. But because I am upgrading the kitchen-(its a rental)- I thought a refinancinig was the way to go--after submitting all my paperwork and paying for the appraisal, and awaiting the final paperwork for my signatures, I received a call from the title company hired by Countrywide, but not the same company who handled the first re-financing, who advised me that they have no proof of the first refinancing, and no proof that the prior owner attended the closing and that in order to receive this new refinancing, I had to go through the same process again-the other party must be present again to sign papers.

My issue with that is-I originally paid 5,000+ on the first refinancing for this service, and I am afraid that something fraudulent might be going on- in addition, CountryWide has not responded to my request to provide me with the prior filed deed from the first refinancing, also, it has been over a month I asked for this refinancing and I might miss out on the opportunity to take advantage fo the current interest rate-- I have sent letters to Countrywide , and the original attorney for Countrywide who handled this process.
