Lisa of Las Vegas, NV February 3, 2010 We were approved for a loan modification. The trail period was for September, October and November. After which we would be approved for a permanent mortgage modification. GMAC Mortgage sent us a congratulation letter stating we are now eligible for a home affordable modification and they would waive all prior late charges that remain unpaid. They advised we would need to sign and notarize the documents and send back by November 25, 2009. We did as they requested. We have made December and January payment with the new modification amount. Our statement still indicates that the account due date is August 1, 2009 with amount past due, outstanding late charges and our old mortgage amount. I have called GMAC mortgage for over a month every week and am told they do not know why our statement is not updated and that the information was sent for review. We have had enough. I finally told them that we have done everything they have asked and we will not make another payment until our statement is current. Mandy of Godley, TX February 1, 2010 My husband and I bought a house in July 2009. Our original lending company (Americahomekey Inc.)sold our loan to GMAC. We were never notified of this transaction and continued paying our mortgage to Americahomekey- who did receive our payments. In mid December we finally found out, by chance, that our loan was sold to GMAC and that we needed to contact them for any questions. I confirmed that Americahomekey had been receiving our monthly payments and was told that they were forwarding our payments to GMAC. I tried calling GMAC to get their address so we could start sending our payments there, but they refused to speak with me or give me the billing address. My husband then called and was told that our home was in foreclosure and that we were delinquent in our payments for the past four months. My husband tried to explain that we were making payments to Americahomekey, but the woman on the phone cut him off saying "I don't have time to listen to your excuses, I hear them all day long." She then hung up on him. Having nowhere to turn, my husband contacted Americahomekey who said they would get to the bottom of this situation. To make a long story short, we eventually found out that GMAC had been refusing payments from Americahomekey because they wrote the wrong account number on their checks. After days of trying to reach GMAC, my husband was able to do a three way call with the two mortgage companies resulting in this matter being "settled." He was told by Jessica (manager of GMAC) on January 15, 2010 that a work order was in place and Americahomekey could send our payment in full, clearing us from foreclosure. It is now February 1, 2010 and we've received notices from the government that our house will be up for sale on March 2, 2010. My husband has been trying to get a hold of Jessica at GMAC, but the people who answer the phone refuse to put him through. Instead they instruct us NOT to send our mortgage payment for this month. Understandably, my husband is upset and would like to know why this matter is not resolved as was told to him by Jessica on January 15, 2010. During another attempt to reach Jessica at GMAC, the guy who answered the phone told my husband to "calm down" when he simply asked to speak to her or another supervisor. Because my husband refused to go through someone who can't handle our situation, he was told to "calm down" and was hung up on for the second time. Now Americahomekey is telling us that this is out of their hands and doesn't know what else they can do. We have exactly one month before our home goes up for sale, and nothing is being done about it. We've made all our monthly payments on time and have the bank statements to prove it, yet we are being penalized for a mistake made by the mortgage companies. I never thought something this ridiculous could ever happen, and GMAC is getting away with doing this kind of business. Their incompetent employees are beyond unprofessional, and honest lives are being ruined because of their inability to handle simple tasks. We are going to lose our house unless something gets done here, can anybody help point me in the right direction? If I had the money, I would hire an attorney myself, but living off of one income at the moment makes that difficult. My husband and I are desperate for guidance on where to turn to get this resolved. Please Help! Joel of ceres, CA January 31, 2010 Gmac bought my 10 year instalment loan from another lender. Gmac changed the loan to a 15 year conventional loan without my authorization or any notice. After a month of phone calls they say we signed a ststement authorizing the change on 1/22/08 yet my statements from Gmac show they changed the loan i 2006 two years before the alleged authorization was allegedly signed. No such authorization was evr signed. They changed the maturity date back to the original 10 yr loan date but want me to make a last payment of almost 4000. The last payment is now due. We have been makeing payments of 145.10 since the original loan was made. we have made 119 of the 120 payments required Heather of Berkeley, CA January 28, 2010 My second mortgage was sold by Homecomings to GMAC Mortgage. Since GMAC took over my loan, I have had nothing but problems with the application of my loan payments. I have always paid at least double the minimum amount due, and Homecomings would properly apply the extra payment toward principal. GMAC, on the other hand, has intentionally delayed or misapplied every payment. It doesn't matter how I submit the payment to GMAC, it has never been applied as requested. If my check memo says "apply all extra toward principal", GMAC will apply it toward a future payment instead. At one point, they showed that no payment was due until the middle of this year, and that they had applied the majority of my additional payments toward interest that had yet to accrue. When I called to have that corrected, the rep told me that she could not reverse the payments because "that income has already been reported to our investors." She finally agreed to correct the payments, but it took a fight. I also tried using GMAC's online payment system, which lets you specify how much should be applied toward principal or interest. After making my regular monthly payment, I used their online payment system to pay the remaining principal in full. The amount of the payment was exactly that of the remaining principal, but I also clearly requested "apply to principal" during the payment process. After a full week, GMAC had still not applied that final payment. I called GMAC today, and a rep told me that the money was being held so that they could calculate interest. When I called back again, the next rep said the payment had been held because they didn't know how I wanted it applied (this is a common excuse that I've heard many times). Robert of port arthur, TX January 26, 2010 I was told the amount we had owner financed would go toward the down payment. Wrong...then before checking to see if it was fha approved witch I thougt was not and told them, they said to have it appraised first. We did now we have to pay 375.00. We had the right credit score at first but now they say it has to be 680.If you choose to do bussiness with this bail out company think twice... Terry of Goodlettsville, TN January 21, 2010 First let me state that I have two homes with GMAC Mortgage. First home is our personal home, the second was my brother's home, who died, and left the home to us. On our personal home, the bank paid our house note each month direct from of checking account. Apparently, GMAC Mortage bought Homecomings Financial. My bank was purchased by Regions bank. On my online statement it showed the house payment and no worries. Then we noticed a lady taking pictures of our home and we chased her down and she told us the home was in foreclosure! After an almost heart attack we found out that when Regions and my bank merged our house payments reverted back to the old lender and were just sitting there. Took me 3 days to get it corrected and had a letter from the bank stating that it was their fault. GMAC refused to accept this and put us on a payment plan for one year with very large payments in certified funds only. No more checks from our bank would be accepted. Only cashier's checks or wire transfers. I spent over 2 weeks every day calling to get this straightened out and was finally told that I would just have to live with it. It also was reported on my Creidt Report that I was delinquent. We were forced into Chapter 13 Bankruptcy because of this. The home left to us by my brother, we were completely up to date on August 1, I sent in September payment and in November received the check back, stating we were 60 days behind and the home was going into foreclosure. I also had sent in the Oct 1 and Nove 1. payments. The November payment was returned also, which made 60 days behind. Countless phone calls, countless hours on the phone and talking to every Tom, Dick and Harry at GMAC we were never told the same story twice. I fax, sent cashier's checks, wire transferred money and they still couldn't post the money to the account. Stated they never received the cashier's check, but I sent it Certified Mail/Return Receipt Requested. I had a signed card where they received it. I had less than one hour to get to the bank and wire transfer the money. Got that done and the next day they said they had not received it, that the Bank (my bank) did it wrong. Now we are on a payment plan with them on this home. Now back to our personal home, got a letter today that the payment has been returned unpaid by your financial institution (the Bankruptcy Court pays the payment!). Called and they stated the signature was not valid. Letter also states they are charging me late charges, and account will be restricted to certified funds only. After just about all day on the phone, getting hung up on twice, and 9 different people, what actually happened was they applied the Cashier's Check that I sent on the other loan (brother's home) to the wrong account and then reversed it, thereby saying we were behind. This is the "demon from Hell" company. Ray of Salisbury, NC January 21, 2010 I had been laid off in May of 2008 and drew unemployment for 3 months. I took a contract job that lasted until July of 2009. Knowing that I was a contract employee and that I could be terminated at any time, my wife started to apply for a loan modification in November of 2008. Trying to a void having to miss any payments. The contract ran out in July of 2009 and I have been on unemployment income since. My wife is disabled and she gets her Social Security income. All of the following happened on two loans. One was our first mortgage and the second was an equity loan. Everything stated happened for both loans. My mortgage company would not allow us to obtain a loan modification because we were up to date on our payments. We informed them of our situation and of my lower income and explained that I would not be able to stay up to date on our payments. The representative from the GMAC Mortgage Company informed me that they were only working with those people who have already fallen behind on their payments, and stated that they could not help me until I missed at least 3 payments. I informed the representative that I had outstanding credit and I did not want to miss any payments, but that I only wanted a loan modification. After missing 3 payments I called repeatedly called the loan modification department. They sent a loan modification package and ask us to fill it out, which we did. They gave us an address where we were to send the package. We called a week later and they did not have the information and ask us to send it again. This time we ask for a fax number, which they gladly gave us. We filled out the information package again and faxed it to them. We called to see if they received it and was told it was not in the system yet. Please remember this is happening on two loans at the same time. After calling constantly each week we were told they need another form that was not in the loan modification package. Or we were told the loan number was not on each page of the package. We sent the packages by registered mail and requested a return signature of receipt (a cost of 30.00). We received the signature and called but no one at GMAC knew where the packages were. We went to our local HUD office to try and get help from them. They faxed the information at least 12 or more times and were told the same stories we were being told. We wrote congressmen, senators, the banking commissioner, even the attorney general office of North Carolina, trying to get someone to help. We finally received our loan modification on our equity loan in October 2009 and kept asking about the first mortgage loan. It took another month before we receive the loan modification on the first mortgage loan. You would think all would be ok but it is not. Because we missed 3 months of payment our credit is ruined. The one credit card we had we owed about 4000.00 on it. We made a 3000.00 payment and received a letter stating that our credit card was no longer active due to our credit scores. GMAC had told us that once the loan modifications were completed our credit score would be fixed and not reflect any missed payments. This did not happen. So now with bad credit but loan modifications we receive a letter from GMAC stating that were have made our equity payments late. According to our cancelled checks we were on time. We now have a late fee according to whom you speak at GMAC. Some have told us it is a late fee, a government fee and other some other nonsense. You cannot get a person who speaks English well enough to understand there has not been a late payment. We have been hung up on so many times I cannot even count them. The mental stress we have been through is almost unbearable. It has caused hard feeling between my wife and I. This corporate monster that controls you has ruined our lives. I am looking for employment and have been told by some staffing agencies that some employers look at your credit scores before they offer you a job. If this happens to me I am doomed. GMAC has not fixed our credit scores as promised. We need help in restoring our credit scores. Also in getting rid of this so-called late payment. Thank you for any help that you may offer. Fred of Montrose, CO January 20, 2010 I have been trying to help several people with foreclosure situations this past two years. I am a real estate broker and I am NOT charging for any services or help:) I just try to help certain people each year as it is the right thing to do:) GMAC and Washington Mutual now Chase are two very difficult lenders to work with and the people who are supposed to be helping you don't have a clue about what they are doing apparently. When people are in trouble with their loans there is no way you can use standard guidelines to try and modify their loans. It takes concerned and caring people who think outside the box to look at each situation individually to see what really can be done and there are lots of options if a lender really does not want to take the property back. I don't see that either party benefits from many of these foreclosures, but I do know the lender will always benefit as opposed to the poor borrower. Lenders get too many breaks when they should, in fact, only be rewarded when they actually help people rather than taking away their shelter and their life:( There are lot of people out there worth saving, such as my current client who has owned and operated an Auto Body Repair shop successfully for many years. Now with the downturn they are paying their rent and bills to keep the busines going so they can pay the mortgage but NO one and I man NO one is willing to listen to their story or help them. It is so sad that there are all these new businesses taking advantage of people who are already in trouble. I know there are few legitmate businesses out here trying to actually help, but they are no longer taking new clients as they are overwhelemed with business. This is not rocket science, but most lenders have a deaf ear and heart like a prostititue when it comes to trying to really help and listen to people- really sad and unfortunate:( It appears that you have to hire and attorney to intimidate and get a lender's attention to get anything done and this is just not right. There has to be a better way and I know there is, but not when you are dealing with cold hearted lenders who got us in this mess in the first place. Anyone out there with any ideas to get thru all the BS with GMAC and Washington Mutual-Chase? William of Florence, SC January 15, 2010 I have worked with them since July 2009. Same story as others. I had to be behind for any assistance. I had never been behind. I contacted them because I lost my job due to the economy and a lay off. I have records of over 40 calls to or from them, three modification submittals and no answers to date. Many cals were to or from Phillipine and India call centers where it was hard to uinderstand what was being told them or what I was able to understand. I was never able to speak to a supervisor. It is now January and I have someone willing to share my home and expenses. That would in itself help me save my home. Now no one at GMAC will even speak with me about my new situation but only say my loan has been sent to loan mitigation and when tranfered to that departrment no one answers. I may well lose my house but if there's something I can do to help but one person make it through the process of saving their home I will raise my hand and volunteer against this MONSTER called GMAC Mortgage. Probable loss of home. Massive phone bills. Huge amounts of time spent giving the same information. Credit destroyed. Uncontrolabe high blood pressure never seen before due to stress. Carrie of Canton, MI January 14, 2010 I applied for a loan modification in July 2009. and for September's payment they told me to make a payment of 873.00 for three months following during the trial period, I did so. I have continusly called and spoke to representives during this time. I recieved letters in the mail that I was behind on my mortgage. I called spoke with different representives and they told me to disregard the letters they were computer generated. and I was in modification, I was protected. I have never in 9 years been 1 day late on my payment. I have an ARM rate mortgage all I ask for is a fixed rate that is lower than the 8.7. In mid December I called they told me I would be approved and I should receive my paperwork in a week or 2. It is now mid January, and I called GMAC to see where my paperwork is and they told me I was not approved and that a letter of Breach of contract was being mailed to me. That they are starting foreclosure proceeding on my home. Remember I have NEVER been late on a payment. Who is this program helping not the American people I think it is helping the banks, they sit on the money to make the interest or what ever their doing. I am a single mother and now I riisk losing my home because GMAC wont work with me. This is crazy. I fit every credential for the modification. I don't understand and they won't explain it to me. I need help. Becoause obciously this Obama plan is not working for the American people. Report Your Experience
