GMAC Mortgage

Holly of Rock Springs, WY June 15, 2009

In August of 2008 I phoned GMAC requesting that I needed to make half my house payment on the 5th and the other half on the 20th and I would pay the late fee. I was not receiving regular child support from my soon to be x-husband. The court had ordered him to but would not garnish his wages until the divorce was final. GMAC would not accept this and instead recommended I apply for a modification.

I gave the man on the phone my information he said to wait 30 days and call back. I did this and was informed that he never submitted the information so I had to do it again! I did this and waited 60 days they finally sent me the modification documents. I immediately signed and notarized them and return them in THEIR prepaid Fed-X envelope. I then phoned them in November as my payment was to begin December 1. I had not received any further information so I inquired about this they told me it was still being finalized and to send my payment in the form of a cashier's check. So I did this. I also called in December and January and was told the same thing.

I sent 5 payments in certified all were accepted. In March 2009 I get a recorded phone call telling me my loan is in default and to contact them to avoid foreclosure. I was told they never received my documents and I should have kept the tracking number on their label to track it. They told me that modification was canceled yet April 1, 2009 they sent me another set of the same documents dated October 2008! and when I called asking what I was to do with it they had not idea why another set was sent to me! Amazing how they received my payments to the same freaking address isn't it?

They acted and still act like its my fault. I was NEVER told they didn't receive them when I called three times only that everything was still being finalizied. I should have been notified in November not 5 months later. So I applied for yet another modification on March 20 I was told it would take 30 days. I have called them EVERY week only to be told to send in more information. I fax everything twice.

May 20, 2009 I called them and the man told me not to send a payment for May as my mod should be completed by July 1. On June 10 I received in the mail a letter from an attorneys office telling me my house has been sent to them for foreclosure! It sure is amazing how they say they don't want to foreclose on your house but that department is VERY efficient at getting the job done while the modification department sits on their asses doing nothing. One department does not know what the other one is doing and god forbid you talk to the same person twice or actually get the loan modification department. I had to be [assertive] to get their extension. They told me they had no record of my modification being done by July 1 and I was sent a letter explaining why the modification was denied, I have not as of today June 15 received any such letter.

I have been working with my PMI insurance company (Genworth) who seems to want to help me deal with these idiots. GMAC told me last week that the house was in foreclosure and the modification was denied due to lack of affordability. Makes no sense I am making more money now than I was last October when they approved me. I finally after speaking with two very rude people spoke with a woman that actually went over my figures, they had me paying on two houses because my name is still on the house my X and I had. He is paying it, it is his.

They didn't even bother to ask me why it wasn't listed on my liabilities sheet. They have caused me because of their incompetence and loosing my original modification to become two more months behind. I think they should be investigated and stopped. They have caused me to become two more months behind on my mortgage and have now sent me to a foreclosure attorney.

Laura of Charlotte, NC June 12, 2009

Filed BK in January 2009. In order for one to keep one car in name all account must be paid up, including taxes. I paid all my account to current any late charges (which I did not know about) + taxes to GMAC and they applied funds to wherever they chose. They did not pay my Personal Property Taxes and now I am behind again. I called and spoke with MANY people in MANY departments only to be told I am wrong. I have got bank statements showing my payments was told to fax them.

The person I spoke with today said I was short a few dollars here & there on payments so they took those and caught up my account. The amount was for taxes & late fees in which my Father in-law paid. I believe they charged me late fees which accrued and did not send notice. They are not telling me I owe taxes still, that I am not caught up on my account. Lost money somewhere in charges that were not disclosed to me.

Mark of Braintree, MA June 19, 2009

I have been requesting that my deceased mother's mortgage be put in my name rather than left in the estate of. I have been trying since March 2009 to do this, and each time I send them whatever information they need, they tell me they need something else, but not until I call them and voice my irritation do they send me a letter requesting additional information. They have been sitting on this request and have been giving me the run around for months.

Caren of Des Moines, IA June 14, 2009

On April 9,2009 I filed a Hardship affidavit with Gmac finance. On May 11,2009 I was diagnosed with cancer. I have made repeated attempts to contact Gmac about the changes in my finances. I am self employed and have been unable to work. I would like make changes to the hardship affidavit, and the people at Gmac will not listen to my request.

Kathleen of Elmira, FL June 15, 2009

If you are trying to get a GMAC home modification...I wish you Good Luck! We have been at it since the beginning of March ( it is now the middle of June). Three weeks ago, after many, many phone calls, faxes, etc. we finally received a packet from them, and were very excited until we opened it up. They had used some "fantasy" figures to inflate our income. The result was to drop our mortgage by 95.00 a month. Would we really go thru this huge ordeal for 95.00?? I think not! Now it's back to square one. We called (again) today and were told 'IT" is in review, but don't know when "IT" will be settled. The whole process is a nightmare, and they're trying to outlast us until we have to go into foreclosure.

Jolyne of sacramento, CA June 2, 2009

I've had GMAC Mortgage for 3 years w/no problems. I received a June statement w/an amount of 6.06 listed in "other." I asked about this and was told that it was a monthly charge in "anticipation" of an increase in my fire insurance. I told them that my insurance wasn't increasing and was in fact decreasing in the amount of 39,000 per year. I was told to call GMAC Insurance Service Center, and got the run around there, so I called my house insurance representative who called to tell them that my insurance was NOT increasing. They wouldn't talk to her about my policy at all.

So I called the GMAC Insurance Services Center again, and was told that 'Sure, have her call and we'll be happy to talk to her.' Guess what? They wouldn't. So I called GMAC Mortgage once more and got a glorified run around again - the two GMAC's obviously don't talk to each other, & I feel like a hostage.

I went on GMAC's website and sent 3 emails to them saying that I've filed a complaint with the CA Attorney General's office, and also a complaint with the CA Dept. of Corporations. I also called the 3 major credit bureau's and told them of GMAC's shenanigans. I am planning to pay my "regular" monthly payment, sans the 6.06 "anticipated" increase.

I'm going to wait and see what happens; carefully document any call, etc, and then file a civil suit in small claims court for the maximum amount IF this is not appropriately settled to my satisfaction. My insurance company is going to bat for me, by sending GMAC an updated insurance policy - of reduced amount. Stay tuned. I'm ready!

Marilyn of Olivehurst, CA May 27, 2009

GMAC has violated the Fair Debt Collection Practices Act. They continue to call and annoy, abuse, and harass me despite my asking them in writing not to do so and asking them verbally not to call me with each and every phone call. This woman, S. Wong, called and left a message with my employer on March 31, 2009, at 2:30. When I asked her why she would call my employer and put my job in jeopardy, she said she had tried calling my house, but the phone was busy.

This company has unnecessarily caused me mental distress, humiliation, and insomnia. They have destroyed the peace in my home for myself and my child.

John of Mount Laurel, NJ May 29, 2009

I have spent 6 months trying to fix an issue with GMAC Mortgage. It seems everytime I speak to somebody they send a request to a team to get it resolved.

It's a simple problem they did not add the escrow payment to my balance and i paid the monthly premium that they told me to pay. Now I am being charged late charges and I have never been late with my payments. It is difficult to deal with so many issues going on these days. How do I fix this?

Max of Westport, CT May 28, 2009

I paid off home equity Lince of credit two years ago. Now I'm refinancing my home to decrease monthly payment at lower interest rate, but GMAC has not released its lien from my property. I requested to do so several time and sent all information they have requested, but they did not even let me talk to lein release department. The rate started increasing and i lost the merit of refinancing. Further I planed to obtain new home equity LC for my son's tuition, but I can't do so because of GMAC's lien over my property. What should I do?

Ken of Carson, CA May 21, 2009

I changed my homeowner insurance company which lowered my annual insurance premium by 500.00 per year. I was expecting my monthly mortgage payment to decrease because my Insurance and taxes are impounded. To my surprise my monthly payments increased by 115.37. I called DiTech [by GMAC] numerous times and talked to several people to get an explanation. Never getting a satisfactory expanantion, I requested they cancel my escrow account. One person agreed to cancel the escrow but requested thay I make a formal request in writing for their records. When I followed up as requested I was told the waiver was declined and no one had originally approved it as I was told. They told me the reason for the decline is my loan to value was over 91% and my property was non owner Occupied.

I have been with DiTech for over 7 years, and paid my monthly payments as agreed. My home value is doubled what it was when I initilly started with DeTich, even in this down market. I am a real reeal Estate broker. I know my property is less that 50% loan to Value and as for being non owner occupied, that is crazy. I asked them what they based their decision on and they stated that is their policy. They did no value check or confrmation on occupancy status. This company is a wreck! My monthly payments have increased from 1528.12 to 1643.49. My initial payment of 1528.12 should have decreased verses increasing.
