I have been in my home 15 years, cnseco was the original mortgage holder and laster sold to greentree. I have paid each month, layoff twice, but was able to pay, 60-90 days past due, asked for help.Always, was talked to very rude, calling my neighbors across the street and so on. Recently, I asked about a modification loan on or about 1-09, was told by tammy that I was eligible,however, the mortgage company had not receive " the salliemae paper work", HUM, still 60-90 days past due, but paid my mortgage each month, accuring late fees, and 800 going to intrest and 119 toward my principal, very disappointing.

We are good folks and do not wnat to lose our home, we work everyday, we are in a mess. I read about the sahdy deals with thsi company each day. This scares me badly.The point is we are still waiting on a modifcation response sicne Jan, 09 and a referrment referal sice May'09.

We have got to find a way to get out of this loan, I fear that this company will try to take our home even though we are still paying each month, and 30-60 days late. There must be a lawyer out there who is willing to help good people like myslef and others in such a mess with Green Tree.

We are behind in payments to Green tree due to unemployment from September 2008 to December 2008 both my husband and myself were laid off from work and not eligible for unemployment compensation. In September 2008 we asked Green Tree for an extension of our payments. Their collection person kept telling us if you can make it until December we you can qualify for and extenton. Thru the entire month of December we were in phone contact with the collection people and 3 times they said they would fax us the extension papers but the papers never came.

On December 31, the last day of the year, the manager, Jack Hansen, said that they would give us an extension if we paid the insurance, whiche we did check by phone. Then at 4 pm, December 31st J. Hansen called and said they could not offer us an extension due to another office went beyond their quota for extensions and therefore they were unable to extend our loan he was sorry and would put a stop payment on the insurance draft. Then he put someone on the phone that he said was the operations manager, and she said that we needed to come up with a payment by 6 pm. I said now how in the world would I do that in two hours, we have already lost our car, she said and you are about to lose your house.

The bank draft was not stopped as promised, that went thru our band and caused insufficent funds. From September to December, we had been promised an if we could just keep paying until December, we could qualify for and extention and then the last minute the manager told us we had 2 hours to come up with a payment. I called this extortion; unethical business practices and just a bald face lie.

Then the manager calls us and tells us we need to work something out. I told him he lied to us, they promised to give us an extension since September. We sold everything that we could and borrowed from everyone we knew to make those payments and for your office to lie to us like that was just senseless and unethical. The amount keeps changing from 482 now to 589 with no explaination of why. Their collections people have threatened us with everything including coming and changing the locks on our doors to eviction notices, and bringing a bulldozer to tear down our attached porch to remove our manufactured home. Our loan originally was 68,000 15 years later the loan balance is 41,000. Something has to be down about those people. We have done our research and we know that the loan can be modified. We know that the interest rate that we are paying now (13%) is so outrageous that no one in these bad economy days can afford to pay it and with only one of us working it is impossible and the other one trying daily to gain employment.

We know that they have a Loss Mitigation office but Collection is where our calls are always directed to even though we ask for the Loss Mitigation department. I am also sending a copy of this letter to the Federal Trade Commission for the Consumer. We respectfully ask that they have their collections people put future threats in writing so that we could send those to our lawyer. If you have a choice do not use Green Tree. Our loan originally was with Bank of America and then sold to Greenpoint and then to Green Tree. And always have a tape recorder handy.

We bought our mobile home in 1998.For 16,900. Lived there till 2004. Because of 9-11 we had to find a job so we ended up moving to Arkansas. We had a contract with a friend(she was already in the park) so she moved into the home and took over payments. She got behind in 2007. After we surrendered the home they came in and sold it for 250.In 2008 we told them we will make payments for the remaining of the loan they said no ALL or nothing.

Later they sent a letter stating they would contact a lawyer in our area..Never heard from them again for 5-6 months asking for money I believe it was Joe..nice guy asked for 1500. to settle I said I didnt have it but I could make payments he said ok for 6 months then lets talk again. Well its 6 months later and we called them back talked to Blaire very very rude person.

My husband was being calm and explaining we could pay her what JOe offered she said NO! that is a slap in the face and that was a one time offer. So we offered payments again she said NO again. She started in on how we agreed to this loan in 1998.She went on and on.(she said that we have a good credit score go get a loan...UMMM no we dont they ruined that!)Not nice at all. My husband came back at her about how much we have given them and so on ..well it wasnt us that was hanging up it was her. Not sure what is next for us.

But I do believe since they took our home and its foreclosed on they cant do anything! Please if anyone knows different let me know. They have ruined our credit by putting it was a charge off. We are trying to do the right thing and pay what we owe but they dont make it easy to do so. I guess its time to let them know who is in control. At first they upset us now we know its all to upset you. Dont let it!

I paid 6 points to get a loan and rate promised was raised to 8% at time of closing. PMI was written into the loan as lender paid and was told I don't pay PMI and will never come off, even after I explained my investment of over 100K improving the property providing proof in an updated appraisal from the same appraiser the bank used 6mo earlier. The home was to be our retirement home and they also doubled the monthly payment because I was late in paying the prop. Tax. This all happened in 1 year. 2007

I'm renting the home because I can't sell it as it's 680K and Jumbo's are not available for anyone at most any price. I'm loosing money every mo. I took out a second. I have a lot of equity at risk.

We presented and offer for purchase of the above listed property on August 26, 2008 the entire package as requested by company. They have simultaneouly made the documents dissapear and we again fax it to them, Donna never responds to any meessages, we may have spokent to her #20 times, The first Mortgage GMAC approved this sale in September 20 and we forwarded the documents to Greenpoint, up to today no supervisor such as Michelle has done anything regarding an approval or decline of the offer, in the mean time, we are still spending two to three hours trying to get to a person to them finally get transfered to Donna voice mail.

The buyer has been patient through the process but I'm worried that the first bank may not want to wait longer and foreclosed on a property which could have been avoided. Noted that GreenPoint has received all documents the same as GMAC who is not waiting for a settlement date pending Greenpoint who is not moving a finger to help this seller who is in this position thanks to the lack of knowledge of lenders.

A buyer is waiting and a foreclosed can be avoided by just forcing GREENPOINT MORTGAGE to do the work just like any lender like GMAC

In May of this year (2008) I came down with an MS related disease. It is called Neuromyelitis Optica or known as Devics Disease. It has left me unable to perform my job with our without accommodations. I cant work due to loss of sensation & mobility, extreme nerve pain, and heavy medications. I am self employed and have been in the same business for 10 years. I have filed for disability.

In May, I contacted Greenpoint Mortgage, owned by Capital One Financial and asked to negotiate my mortgage explaining my hardship in a letter. I received a letter from Greenpoint in July asking me for a detailed accounting of my personal finances. After extensive documentation - tax return, income to loss statements - bank statements - and personal hardship letter to Greenpoint Workout, On August 26th I received a one page letter from Georgia M in Customer Care, denying any help with my mortgage, based on expenses exceed income? In addition, Ms M suggested that if I were to consider selling my property in the future the investor of your loan may consider your loan a candidate for short sale.? In other words, When you defaultwe will buy it on the cheap.?

I am not sure of those with a disability that prevents them from working have any rights or resources to force Greenpoint to make an accommodation either by lowering the interest rate, refinancing the loan, or providing proper options to the disabled that would help prevent them losing their home. I am current with my mortgage payments to Greenpoint. Thank you for your time. More information will be provided upon request.

I received a late payment on my july Mortgage payment of 54.04. I called Greenpoint To find out what month was late. I was told my July payment was late. I explained I did not receive a bill amd when I noticed that no payment was made i sent a payment. The service personm stated when I signed up on line, that they cancelled mail payments and send E-bills. When I wxplained I receives no e-bill. They then said e-bills were a courtesy not a surething. When I asked to speak to someone who could help mr I was told no manager was available. But thet stated I would have my call returned in 48 hours.

After 72 hours I called back and spoke with mr. Alec Gupta, the man who was suppossed to call e back they said he was in a meeteing the same excuse I received 3 days prior. I asked for another Manager I was told they were all in a meeting but that Sarah George had voice mail. When I requested her voice mail. All of the sudden Mr. Gupta got on the line. He basically stated that I was given information about the lack of statements when I went on line. He said they send e-bills, when I asked for a copy of the e-bills ha said they don't send e-bills they send reminders, when I asked for a copy of the reminder he said they were a courtesy only. That I have my 100 pages of the original contract to tell me my due date. Any documentation regarding this e-bill, reminder, or web site info could not be sent to me.

Mr. Gupta said that i should have known my due date but could offer no assistance provideing this information. Mr. Gupta constantly changed his story and could give me no documentation as to how I was informed of thier policies. He simply blammed me for paying the bill late. This is the poorest customer service I have ever recieved. He never at any point showed me any way I could have received the information as to thier policies and my due date. Scott P. Sheeran

They have 45.04 of my money and are totally blame me. Although whrn asked they cannot provide me with the information requeasted
