Kimberly of Halifax MA (04/04/09) My husband and I have been living in this home for 10 years. We have three small boys and ran into financial difficulties in 2007. My husband is self employed in constuction and ran into a slow period. I started advising indy mac of this. April of 2008 my husband was blessed- he drove into a new construction area and was given a great business opportunity which has lasted. He is making enough money to cover our bills but indy mac is not helping. First they said we needed to be put on a repayment plan - we made the first payment then indy mac sent us a chance for a modification lowering our payment we made our 3 modification payments on time by money gram to receive a denial letter for the modification
when I called indy mac I spoke to Sara combs employee # 553 on 1-22-09 from 8:45 am to 9:55 am she saidit was not a true denial in house error. She said I had to get on a repayment plan so they could do modification over. Our repayment plan they gave us was due february 1st . she said after 3rd payment their will be a modification in place. Since we made our last modification payment on 1-15-09 I requested that payment be put towards the Febuary 1st repayment and I would pay the difference - this call took place on 1-30-09 I spoke to Malory # 04T she spoke to a supervisor and said yes they would take the modification payment sent on 1-15-09 and put it towards first repayment plan due feb 1st -
I money grammed the amount what they told me to do on feb 1st. Indy mac sent the payment back on 2-10-09 to money gram saying it was not the full payment. I spoke to Ruthe employee # 15y and said the arrangement was set up incorrectly and no one was supposed to approve the above because the funds were already put towards the back of the loan - she put me on the phone with the supervisor Jeronemo employee # 55m and he said I would have to be set up on yet another repayment plan due to their error. The new repayment plan would start 3-5-09 we made that payment by money gram and our next payment is due 4-5-09 . I received a letter yesterday 4-3-09 stating we could not receive a modification through their company - they have not asked for any updated information on employment or last years taxes just sent another letter pulling the rug from under us.
I AM FED UP WITH INDY MAC --- I NEED HELP - I am making my payment tommorrow by money gram for my second installment for my repayment plan they I have one more they they want a balloon payment of more than 20,000.00 YES I WILL JUST PULL THAT OUT OF MY SPARE CHANGE FUND. I am going to loose my house if someone can't help us. We have 3 boys and a loving family - a hard hard working husband that is finally making enough to support us . We can do it we just need help getting some company to see this - Indy mac is no help I have done everything they have requested I have all the notes , money gram receipts, employee names and #'s, dates times, EVERYTHING--- PLEASE HELP! MY HOUSE AND FAMILY DEPENDS ON THIS.

Tamairo of Milwaukee WI (03/23/09) On February 5, 2009, I called in to report a fire loss for one of the properties that I own. I spoke with an incompetent agent who did not advise me on how to deal with my fire claim. I was just told to send in the check when I got it from my insurance company. All I have encountered are inexperienced staff from Indymac. They seem to be more concerned with getting the check. I didn't receive the information that I needed for my property loss until the last minute. I am incurring charges from the city. Since Indymac Bank wants to take all of the money without understanding what my needs are in my insurance policy, I haven't gotten anywhere with my claim.
I don't know who is worse...Indymac, or my insurance company. Neither one seem to know what they are doing and I am tired. Phone conversations with a Supervisor named Megan were disconnected. Phone conversations with Matthew Slusher were argumentative and did not get to the root of the problems. Everyone here lately that was supposed to be working on my file has either resigned or been fired by the company. I sent in a paid overnight envelope. They lost my envelope. They wouldn't endorse the check I sent. They sent the check back without my overnight envelope that I paid for.
Overall, I am still at square one. I have rent losses in my insurance policy that I am supposed to receive. Indymac is trying to keep all of the money to themselves to pay down the mortgage balance. This would be fine. However, it needs to be done the right way, making sure that my contractors are paid for razing the back property, and that I receive the monies that I am supposed to receive from my policy that I pay for every month. There are two structures on the lot. One burned down. Indymac has not done their jobs properly to make sure that I won't be paying for a property which is underwater. No appraisal has been done on the existing property that hasn't been done.
More time is being wasted because I don't have any cooperation from Indymac. The city wanted the building razed by 3/19. I didn't make it. The best I can do is ask for an extension because of all of kaos with this and hope they give it to me. Otherwise, I will be subjected to more fees. All details have not been worked out which is why Indymac doesn't have the check back yet. Preferred Complaint Resolution: Indymac reps need to be competent, follow the law, not argue with the customer, and send my overnight envelope back that I paid for.
They need to honor my rent losses that should come to me, money that is owed to me in my policy, modify my loan and write down the balance for the front house that is still standing with a decent interest rate, making sure that I am not paying for a house that is underwater in value. This all needs to be done in a timely fashion. Time is of the essence with this matter or I face city fines. How can I trust that Indymac will not have me paying for a property is underwater, when they take the rest of my money from the insurance check?
It is taking forever to work out the details. I don't have my loss rent check and I am being left for last on that. I am being charged for board up fees as well as debris fees. I shouldn't have to use my own money when I have insurance. Because Indymac has not cooperated, and still haven't to this date, I am in a pickle Theresa of Vero Beach, FL March 11, 2009
Theresa of Vero Beach FL (03/11/09) IndyMac is my mortgage holder. I have never paid my monthly installment late throughout the history of our relationship. I contacted them several months ago and INQUIRED about a Loan Modification due to a sudden decrease in my salary. I was simply hoping to have my mortgage interest rate reduced (without points, fee's or penalty) which would in turn reduce my monthly payment. My other mortgager (Ocwen) had given me the same consideration, without incident. I answered some financial questions and was advised that while my application was being reviewed, I should pay a new monthly amount (532.31) instead of my former 739.56 monthly payment.
Likewise, the rep advised that my new due date would be the 16th of each month, rather than the 1st. I was advised that after three consecutive, on-time payments this new rate would become PERMANENTLY FIXED at 5% for a total of five years, and rate would never rise above my current 6.67 rate thereafter. Suddenly my creditors (all in excellent standing for over 20 years) bagan sending me letters explaining that derogatory information on my credit reports were causing them to lower my credit limits.
Indymac began sending me letters suggesting that my property was turned over to the Loss Mitigation Department, field reps began visiting my home and photographing it, they opened an escrow account, paid my property taxes and my statements all indicated that I was 90-120 delinquent on my loan. I diligently challenged these damaging discrepencies via their ONLINE SECURED MESSAGING service, only to receive brief, computer generated and eventually rude replies, offering sarcastic replies and refusals to correct the errors. A package the arrived in the mail giving me 5 days to sign a Home Savers Loan agreement, offering to give me an unsecured loan of 15,000 in which to assist me with saving my home from foreclosure, etc.
Again, I contacted them to advise that I DO NOT WANT AN ADDITIONAL LOAN OR ANY SUCH PROGRAM, AND THAT I HAVE NEVER MISSED A PAYMENT TO DATE. They advised me that their records indicate I have only made partial payments and therefore no acknowledgement of any payments from me have been posted since prior to December, 2008. They are DECEPTIVELY using my inquiry about a lower interest rate as a means to have me appear deliquent in an effort to either foreclose on my home or force me to borrow money that I do not need and did not ask for! They refuse to speak with me and I am prevented from making online payments due to the erroneous past due status on my account. Letters, calls and all correspondence to them falls on deaf ears. They indicated to me that they are being removed from FDIC and that they are uncertain who their CEO may be when I request this information.
PLEASE HELP ME. I simply want my credit repaired and someone to acknowledge that by following their instructions, not by negligence, etc...I was overlooked, deemed as a risk and now living with a stressful, expensive MESS! I want my original payments...NO HELP, NO LOAN, nothing but an internal investigation that will unequivocally prove that I am creditworthy, innocent of wrongful allegations (delinquencies, etc) and resolution! Please send me a copy of this complaint, as my printer is malfunctioning. Any assistance from you would be TREMENDOUSLY appreciated!

Jeanne of Albuquerque NM (03/01/09) In the summer of '07, I told Fidelity I wanted to take about 90% of my money out of the stock market and put it in fdic insured cd's because the market was beginning to get volatile. I went to bankrate.com and found the best rates were at Indymac (guess why!!!). I called them 3 times and talked to 3 separate people. I wrote down the dates, times, and names, and exactly what was said. All 3 assured me, each of 3 accounts would be fdic insured for 700,000 each because I had a trust with 7 beneficiaries. All 3 lied! I bought 1 yr. jumbo cd's which would mature on Aug. 8, 2008. Jul 12, 2008 the feds shut them down and took the equivalent of 20 years' salary out of my Roth and gave me back 1/2, saying the rest was uninsured. Indymac then made 27 unauthorized transactions in my 2 retirement accounts before I was able to get the money they didn't extort from me away from them. Many months after they were shut down and taken over by the feds (still same incompetent employees), I was on the phone with indymac and Fidelity (teleconferencing) and the indymac people were still telling the same lies about how much is insured by the fdic. Don't ever believe a financial institute about their insurance. Check out their insurers' written statements (if they are understandable!!). Watch out for many loopholes too.
I lost 10 years' salary -- 1/2 my life savings -- because they made fraudulent loans with my hard-earned money. The FDIC told me I can't sue the bank because they don't exist anymore. (It's now Indymac Fed Bank!). The FDIC told me when they sell the bank, I will get back some of the proceeds. The bank was sold and guess who got the proceeds -- the FDIC! What a bunch of crooks. Maribel of Moreno Valley CA (02/18/09) My mother died at age 72 in April 2007. two months before she died she decides to refinance with Indymac. I was not aware of what she was doing. It was around February or March of 2007 that the house loan was solely under my name. I was strictly the owner and my mom was not on the loan. My mom did not speak a word of English did not understand anything they explained to her. She was elderly and I suspect she is a victim of elderly abuse by the broker and Indymac. She signed documents authorizing Indymac to take my name off the loan. When that was done with my mother dies in April of 2007 leaving me off the loan but I was still on the deed and Title with her included. I was alright until April 2008 I loose my job and in June 2008 get into a car accident. That is when I started falling behind on my mortgage payments.
I sent everything to Indymac but they don't want to talk to me because I am not on the loan. I want to see if they can help me get a modification or something so that I save the house. Unfortunately they cannot do anything because they want a power of attorney which I can't get my mom never had the time to do this. She died instantly at our house and never got the chance to write a will. Now I am afraid I will be in the street with my little girl because my credit is messed up because I was making payments to them and I was not paying any of my credit card bills. I do have a job but my job through Los Angeles Unified school District is on Freeze. My concern is that I have an older sister she wants the house to go through probate. I don't want to go through probate my intentions are to save the house and live here and continue paying the payments if I get modified. But Indymac just today said to Fair Housing that I need a Power of Attorney. How can I do this if my mother died instantly. This only happens when the person is alive.
Now that I'm oweing 17,000.00 in the property the property don't have any equity I will be forced to leave my house. I can't afford an attorney. I need a home to live in for my daughter Alexandra who is 8 and myself. My mother wanted me to save the house. Now I don't make enough money because the job I hold is not an everyday job. My concern is what options do I have to take over since I owe so much. Plus my mom was not told exactly what she was signing she signed and that was it. Now who can I talk to my credit is messed up. Unemployment don't want to give me money, I have an elderly woman living with me age 85 she is here with me. I can't loose the house I put my retirement money and school loans into the house. My daughter who is 8 is scared and sick and I can't sleep. I need advice and help to save my home which I greatly need in order to live.
It has caused me alot of heart and emotional problems. I can't sleep afraid that I will be left out in the cold with nobody to turn to. I don't have family or friends they live far away from me. They have there problems to deal with. I don't know what to do. My only daughter cries alot is gaining weight and its affecting her in school she is in depression I am to. I am afraid that I need a lawyer to help me solve this as soon as possible because the house is in forclosure I only have 6 months left. Please help me. Also I have an elderly Aunt who suffered various strokes this is her home to she doesnt want to give it up because she invested in it to. I am afraid I don't know whom or where to do. Please Please help me I plea that I need your help. Indymac is not helping. I need guidance. I wrote to Pres. Obama and the Senator everybody about this. Nothing has changed. Help me Please!
