Cynthia of Orange, MA September 6, 2009 After reading this stuff I am feeling very vulnerable! I am in the "loan modification work out" period. And like so many other here comment, Litton continuously DENIES that they have gotten the "needed documentation" that has at this point, not only been sent, but also RE-SENT! I have an email from them stating they did not get documents which over the phone at prior times they acknowledged RECEIVING! So, I faxed the SAME stuff to them, AGAIN-- 14 pages worth. There is NO accountability for them. If you send it and they SAY they don't have it, then what? I also made the #1 payment in accordance with information they sent me-- well they agree they got that ( yuh, I can prove that since it went right out of a checking account) BUT they then say they WON'T CREDIT IT BECAUSE...? They don't have ALL the documentation? Really? Why not, you've been sent ALL the documentation, TWICE NOW. Furthermore, when they spoke with me initially, they did NOT tell me that I did NOT have to include child support. Just the opposite, stated must tell about ALL income, including child support. SO, the child support was then used to determine my ability to pay. FINE. THEN, I get the packet where it states that IF the child support will NOT be continuing for THREE YEARS forward, it CANNOT be included. Make up your minds. I don't think it should be included, since I know it will stop within the next TWO years. I have lost ALL the income I had from self-employment in 2008, because the place I contracted with just terminated my spot without ANY advance notice, it has been a struggle. However, I took a job with the Census, that gave me enough to get the property OUT OF DEFAULT in the Spring, but THEN, that work ended. Now I might be called back, and I'm afraid if I take that TEMPORARY work, they will then USE THAT against me, and say well you CAN pay now. Sure NOW, not in another month though, lol. Do they know what TEMPORARY is? I am trying to get back into working for myself, but I need MONEY to do that, and right now I have no extra money. I also read that you are allowed to have enough in savings to cover your expenses for two months, BUT I have NO savings at all. SO, basically IF they just keep denying they have my paper work, my mortgage goes into default AND they just KEEP the 3K in payments from me, gravy for them and I owe them for three months of mortgage payments? WHAT IS THEIR INCENTIVE OR ADVANTAGE TO EVER ADMIT THEY HAVE THE DOCUMENTATION THEN? They take my 3k, take my house, and put my documentation into their shredder apparently. HELP! What should I do? They say you don't need a lawyer, but apparently YOU DO, to keep THEM honest? Joseph of Chambersburg, PA September 5, 2009 We have been trying to work with Litton loans servicing for months.Before Litton our mortgage was with Countrywide. After submitting all information necessary for a loan modification and several phone calls telling us that it is still under review. We were told we did not qualify according to the terms of the investor and to resume making your monthly payments which have increased by almost 1000! It has been two months since we received this letter and every week we leave a message, no one to date has contacted us. It has been a year now, I am afraid we will end up losing our home. My wife's income was originally used to get us qualified for the loan,but her name is not on the deed. Is this legal? We also was working with Apply2save to help us with our loan modification and they filed bankruptcy. Our entire household is exhausted and fustrated! We don't know if they hold the deed to the property or not. Shannon of Romulus, MI September 4, 2009 Well, here I am again. I started thinking about the amount I paid for my 9/1 payment and realized I way over paid. I had paid more for 7/1 & 8/1 than my original payments (my original payment had no escrow so a large part of my trial payment was to set-up the escrow if I qualified for the mod). Anyhow, they basically charged me 614.85 in forbearance suspense and late fees for the "partial" payments for 7/1 & 8/1 since most of the payment went into escrow. Basically, I ask for help and they helped themselves to some extra money! Shannon of Romulus, MI September 3, 2009 Just one more thing to add to the post I submitted earlier today regarding trying to get a modification with Litton. After the rep told me that the offer expired because the tax return copies were missing signatures, I then was charged 60 some dollars for late fees for July & August, even though, I was paying more per month because the modification included escrow which I don't currently have. They get you any way they can!!! Shannon of Romulus, MI September 3, 2009 Like many others, I was trying to get a loan modification through litton. I went to make my last trial payment today, 8/3, (my mailed payment came back to me for an error on my part). Anyhow, I spoke to a representative and they said that I was back to my regular payments due to some missing signature on my tax return. I had sent them a copy H & R Block gave me so there were no signatures on it. Basically, I have to now resubmit everything and they will then work out another 3 month trial period. Talk about making you jump through hoops! I have been my families only income. I have been cashing out what was left of my father's retirement account after he passed away and it was split between my two siblings and myself. Now, in hind sight, I should have taken that cash, bought one of the houses in my neighborhood that was foreclosed on and sold for 20,000 & 30,000, and dump my house that is financed for 135,000. Then I wouldn't have a payment at all! Irving of Chesapeake, VA August 31, 2009 Poor Service on Loan Modification request going on since December 2008. Finally received notice of Loan Modification does not meet lenders criteria, July 2009. I asked what the criteria was and they told me they do not disclose that information,very helpful for average harry homeowner who is trying to save there largest investment in there life. I return to Hope Now for some kind of appeal and they speak with Litton and us, Litton loan says they will resubmit request to the appropriate department.They explain that i need to resubmit some information and we do that and they tell us to resubmit check stubs, we do with my wifes and before i get my first stub from my new employer we receive the same form letter, we do not meet the criteria of the lenders for the modification. I am going to see a lawyer tomorrow, i would love to to have enough people for another class action lawsuit because i think these people are violating truth in lending, respa, tila and lots of other laws, i hope to find out more tomorrow. emotional, severe financial already happened but just not knowing weather forclosure is looming is enough to send anyone to the looney bin. nancy of fredericksburg, VA August 30, 2009 Iwant to save my children home.lack of commincation,they keep increasing the repayment plan. they keep threating to foreclose my children home.I have lost weight,can't sleep. Kristy of Kansas City , MO August 29, 2009 My story is much like everyone elses! I requested a loan modification with Popular Mortgage when they informed me that my loan was being sold to Litton Loan Services. They told me to wait until I was notified that they held my loan and request modification from them. This was originally requested in October of 2008. My loan was at a 10.3% ARM. I lost a business and became unemployed. My fiance was having to pay for everything under his income and my unemployment. Litton, by phone, informed me of everything that I needed to send to them including a hardship letter, tax forms, proof of pay, 4506t, and more for both myself and fiance. I sent the documents by fax as soon as I gathered them. Several months later to recieve a letter stating that my income was sufficient enough to make my house payment so I was denied. Called them again, requested another modification and they told me that I could not request another modification until it had been 90 days from the last request. Then I recieve a letter that they are participating in the Home Affordable Program. They requested that I send everything again. I Fed-Ex'd it all again. Called to check on the status and they informed me that the Home Affordable Modification Program had not yet been approved by the government yet so they would try to inhouse modify it. Again, I had to send everything again. That went on up to 5 times. This is my 5th attempt to modify my loan. I was behind in my taxes on the home too. Insurance was paid though. I had fallen behind on my mortgage about two times. Now, they have put me on a 3 month trial modification. My payments went from 1656 to 1404 with my interest rate being reduced to 5%. I thought, "Finally, I am getting somewhere!" Haha! Right! After my 3rd payment, I called and they said that they are now participating in the Home Affordable Modification Program. Now they are seeing if I qualify for that. I receive a letter in the mail yesterday dated August 20th, 2009, informing me that my loan has been modified and my new payment is 1883.04 with my interest rate back at 10.3%. Oh, and I still get foreclosure letters all of the time! They say that if I don't pay 7500 by September, they will start the foreclosure process. How does increasing someones payment and interest rate help them be able to afford their loans??? I think I am going to contact an attorney! This is just absolutely absurd! Noone there knows anything either! I am not going to be involved in some class action suite against them and recieve 60 for what I have gone through with them. I am just sick over it! This has been a nightmare! If anyone has any suggestions, please let me know! Zea of Wixom, MI August 27, 2009 I was attempting to get my loan modified and Litton finally sent me a workout plan, I made the reduced payments as stated for the three month trial period and upon the last payment they send me an accelerated foreclosure notice demanding 2K. This is after they lead me to believe the modification was being processed. I was not late on my payment prior to this and with the reduced payments they have reported me three month's late, are now foreclosing, and haven't receipted previous monies received to my account. Exomar of Altadena , CA August 26, 2009 February 04, 2009 I applied for a loan modification with Litton Loan Servicing my account number with Litton is 41100074. After submitting all the required documentation numerous times I was granted a temporary loan modification to see if I could and would make the new monthly payments. I was told by Litton the new monthly payments would be for a three month trial period. I paid the new monthly payments on time for the three month trial period. The trial period has just ended and I thought the subsequent monthly payments were going to remain the same but instead I received a (NOTICE OF DEFAULT AND INTENT TO ACCELERATE). It seems to me that Litton Loan Servicing was not dealing in good faith with me and is attempting to foreclose on my property. I find this uncomprehendable and it should be illegal to allow a large institution to basically steal a consumer's home in this despicable manner. I did everything the bank told me to do and still they want to take my home. It has been six months now since I first applied for a loan modification and it is very frustrating to be in this situation. I would appreciate any help anyone can give me at this point, thanks. I may loose my home, I am not able to sleep and I worry all the time. Report Your Experience
