Well well looks like we are all getting harassed by B of A. Thanks right. I sent my mortgage payment with my coupon on August 7th to TBW. On August 21st I receive a collection call from B of A stating I am PAST DUE on my mortgage. I explain that they have the wrong person because my loan is with TBW not B of A. Much to my surprise I was told that TBW had filed Banko, Coloniel Bank was shut down by the FDIC and FBI and B of A was my new mortgage company.. Yay for me .. Not. I explained to the person that I made a payment to TBW it cleared my bank on 8/11/09 and they need to get the money from them. They told me at that time not there problem and that when could I make my next payment. Well I received a call everyday and night from someone at B of A and from India no less. The last straw was when they called me at work while on the phone with them already. I wrote a letter (6 pages) to Bank of America Home Loans, and Ken Lewis President of B of A. I also copied the FDIC and the Cash Comptroller for National Banks and Department of Justice. Well the calls have stopped but my payment is still out there. Frozen they say. Ken Lewis' assistant faxed a letter to me today, I called back and left a message. I am curious to see what they say. Do what I did put in writing and copy everyone above I listed. This is harassment and we all work hard at trying to survive in this economy as it is, let alone having our payments hijacked!

we had a home mortagae thur taylor,beam and whitaker for 3 yrs. we used a equity accelerator to make our payments. that is a company that takes 1/2 my payment out of my checking account per pay-day ( i get pay every two weeks) my payments are aways on time that way. this past aug the two payments were taken out for the sept. payment,this is went the feds went in closed taylor beam and whitaker my money is frozen until the courts can rule. when will i get my money back? i did nothing wrong i can't understand why the equity accelerator can't give me back my money they said that it's sitting in a account with them. it never was send to taylor beam and whitaker. i have closed my account with equity acc. and my mortage is with bank of american. i've had to scramble to make sept's payment please help i want to know if i will ever see my money again

I went to do my online payment in August to TB&W and it said my account was restricted. I couldn't figure out why. I couldn't get through on the phone that Thursday, and on Friday I finally got through to someone after being on hold for almost an hour and was given Cenlar's phone number and told that the feds had shut TB&W down. I called Cenlar and was given an address where to send my payment and that it would only sit there and not be cashed until after September 1 so I may a well wait for a letter that would be coming from them with a new account number, as I had not gotten any thing in the mail from TB&W saying that my mortgage had been sold to another company or any thing. So I waited and finally about week half later I got a letter in the mail from Cenlar with a stub for my August payment. I had also been told that payment coupons would also be coming soon, when I talked to Cenlar on the phone. I mailed my August payment approx Aug 28, and it did not clear my account until about Sept 10. I did not get any thing in the mail from Cenlar until 2 days ago and they sent me a coupon and a 2 page letter, the coupon says for payment due Oct 1.

There are no phone numbers on it to Cenlar for customer service, no mention of a statement as to how my August payment was applied, nothing, nothing but a website to sign into get account at Cenlar. I went to that website and there is no letterhead on it, just a generic page asking for personal info, including SOCIAL SECURITY NUMBER. No phone number, nothing on it. I am not about to do this as what dummy would put there ss# on a generic page? The only phone numbers that were on the letter that I received were for where to send your property insurance bill or tax bill. There was no mention of escrow accounts or nothing. It also said that I would continue to receive monthly coupons from them for my payments. The coupon wants my entire amount due which includes my escrow. Where is the money that I had in escrow. My taxes got paid for the ones due June 20, but now I wonder if my property insurance is going to get paid. I do not dare to send any money to any where that I don't get complete accountability for it, where there are no phone numbers and all the addresses on the letter are just po boxes, no physical addresses, and we don't receive any correspondance in the mail, no statements, nothing. What is going to be done with this so that consumers know what is going on?

I think I need to call my state offices and the local media. I have been patient long enough as I was expecting to get some thing in the mail by now to resolve this and I don't want to get behind and I want all of my escrow money that was accrued by them up until they take over. Someone needs to wake up. Next time my property tax is due is Dec 20, 2009, and you know that is Christmas and just because this is not getting taken care of do you think I want to forgo children's Christmas just because my taxes and stuff will not be paid? I have seen alot of complaints on the website but not have heard any thing in the media so I think maybe I need to find a channel that can find out what is going on. I would like an answer or some information, please. Alot of people have mentioned that they have been contacted by B Of A and other places. I haven't heard from any one except the two letters and payment coupons I received in the mail from Cenlar.

Paid August and September payment to TBW, the checks have not been cashed. FHA says do not send them money, they are closed. I keep getting late notices from TBW. The Florida Attorney General said they issued a Cease and disist order against TBW. What does that mean for me. I am afraid to send them any more of my money after reading all these complaints, the money is not being applied to our mortgages and the new companies are saying they don't know where the money is and to send them the money. If we have already sent it to TBW, most of us do not have additional means to send an additional payment. TBW website still says they have our loan. Does anyone out there have any useful information. I am scared we will lose our home because of their troubles.

I had gotten a couple of calls from an automated voice asking that I call BofA at my earliest convenience. Having gotten several emails from them wanting me to refinance I ignored them. Then I received a letter in the mail on Sept. 8th, 2009 from Bank of America with a notification date of August 23rd, 2009 Stating that as of August 5th, 2009 all future mortgage payments were to be made to them as TB&W were no longer in business. There was also a bill owing for the month of September. I called BofA to find out what was going on, of course, and was directed to the "Home Reclamation Dept", their fancy title for "Foreclosures". This was when I discovered the FDIC had closed TB&W down, their subsequent bankruptcy filing and my loan being sold to Bank of America. I was also told that any reports to credit reporting agencies and late fees were being held for 60 days according to Federal law. Knowing I was current on all payments I asked why I had had my contract put in that dept. The answer was that I was 2 months past due, which I knew to be impossible as I voluntarily have my payments taken directly from my bank account by another agency every two weeks for the monthly payment to be made the following month.

BofA claimed the August and September payment had not been made. I tried for over half an hour to get the person to understand that these had been made and were taken from my bank account. Finally I got a supervisor on the phone who also argued with me that the payments had not been made. Finally he told me the September payment may have been made but would be held by the court for two to three weeks and then the funds would be released to BofA. The August payment did not show at all. After another half hour I convinced him to call conference the company who had made my payments. At first he outright refused, then was very surly in saying he was not allowed to do so, but finally agreed after I told him I knew for a fact he was as I had dealt with erroneous creditors before. We spoke to the company, found the August payment had been made on time and the September payment had also been made but was, indeed, in the frozen asset accounts of TB&W. No further money was to be deducted from my account until this was all settled, then a new account with BofA would be set up. Until that time I would be responsible for making my payments directly to BofA. During this conversation the supervisor asked that all paperwork and documents be faxed to him, gave the agency the number, told me he could not stop the computerized phone calls asking for payments but the personal calls would stop, and hung up leaving me on the phone with the poor guy. He said it would be two to three days and everything would be sent to BofA by fax and I would receive paper copies in the regular mail.

Six days later I get a personal call from the collections dept., wanting to know when I would be making payments for August and September. I explained I had already gone over this with a supervisor and the documents should be in my file that I did not owe this money. He said no such documents were in my file at first, stating I needed to make a payment right away to prevent 'further action'. I then reminded him that by law I had 60 days, that I had already proven I did not owe any arrears, and it should be in my file. He then admitted that yes, it was in the file, but was not 'validated' therefore not relevant. I asked to speak to the supervisor I had spoken to before and was told he was 'unavailable'. I asked for another and was told everyone was busy, that I could call back the following day. I asked him why, when I had spoken to a supervisor who stated he would make a notation on my file, had the phone call recorded by 'quality assurance', had a third party witness the conversation and verification of payments, the entire process could not be 'verified'? His response was to continue to state that until I make the payments I would be receiving these calls. The only way to stop them was to fax a request for them to stop and explain my reasons. I do not have a fax machine, told him that the calls were already supposed to stop per the supervisor I had spoken to prior to this but did say if he wanted I could get a letter from my attorney stating harassment. He continued in the line of me owing and need to make payment and so on, ignoring everything I had already said. I hung up.

I had a mortgage with Taylor, Bean & Whitaker for two and half years. I was never late with my payment even during times of unemployment. In that two and a half years I paid them over 26,000 in interest alone! On July 22, 2009 I sold my home and paid them off. I recieved my escrow disbursement check in the amount of 1142.08 on August 24, 2009 which bounced in my account with no explaination from them.

I have jumped through hoops to try to contact someone to help me. This is my money! If the FEDS were going to freeze their accounts they should have completed their business first and made sure that their customer were not going to pay for the mistakes the this mortgage company was making!

Lets face it the government has our escrow money and the government is responsible for paying us back! I don't have my money, I'm currently unemployed (the reason I had to sell my home in the first place) and have three children to take care of. I probably qualify for assistance but, I am an american citizen that don't believe in food stamps and that kind of stuff.

Taylor Bean and Whitaker had my mortgage loan. I had an escrow with my account. They took the money out of my escrow account for my home insurance. It was never paid to the insurance company. I want to know where my money is? My insurance will be cancelled.

Short! Made my on-line mortgage payment (August 2009) as usual (I actually had this set-up for the year as to avoid being late(what I thought being a responsible person should do). the money was debited from my account (trust me, I checked with my bank and the money was indeed debited). It wasn't until September I find out that Taylor Bean went under. Band of America has my loan, but of course is stating/claiming that I am in arrears for August 2009. I explained and even faxed over proof of this - now no one at Bank of America can locate all of the research and paperwork I faxed over. According to them, I'm still late. Also, Taylor Bean never paid my home insurance but my insurance was included in my mortgage payment! Where's that money?! No one has it.

I too have a mortgage with TBW. I had absolutely no idea the company closed until I received a letter in the mail from an unheard of lender informing me they were able to DEFINATELY refi me. When I called them, they told me they were not licensed in the state of IL and they had no idea how I received the letter from them. I've called all the numbers associated with TBW, BOA, and any company supposed to be taking over my mortgage, without receiving any help at all. Most of the numbers are not even in service. I've not been able to make Aug or Sept payments. I've never missed or been late on a mortgage payment in 26yrs! We are in a tight situation to begin with because of a shady mortgage broker that promised us the world and unknown to us, over valued our home to get the loan in the first place. We were never able to see the appraisal. He was just interested in his cut. We can not afford to let the credit scores slip further. No one will touch us to help refi without any mortgage info. And missing payments does not help anything.

This has been a frustrating week for my family. We actually pay our mortgage a month in advance every month and have for the last 2 years since our mortgage was immediatly bought by TBW. Everything has been fine until a few weeks ago when I saw a letter from Bank of America. I had almost thrown it away as we are always receiving refinancing offers in the mail. It basically said that B of A was the our new lein holder and any payments from Augest should be forwarded to BAC Home Loans. Well by the time I had recieved this letter, in the fist week of Sept, I had already made 2 payments for September and October by cashiers check. This was unsettling to me and I called B of A to inquire about those payments. The rep said the file was in transition and not to worry as I had 60 days with no fees.. What? You owe for September. But I paid this as well as Oct. We went around on this and the rep suggested that I contact TBW. So I called them, and a female rep said that my cashiers checks were sitting in a lock box in Orlando Florida and there was no telling when they would be released to B of A. She also told me about how she had seen the pink slips handed out to the employees after lunch.

I then called back B of A and asked them my recourse at this point and was told it would be in my best interest to cancel the checks or just wait, After all I had a 60 day grace period that was ending Oct 1st. So I went to Chase with my cashiers check stubs and asked them to stop payment on them. Each check I send is clearly marked for which month the payment is for . They told me that Augest and Sept had bothe been cashed and they made copies of the canceled checks for me. I paid for an assurity bond to cancel the month of Oct and that was reissued. While in the bank I called B of A and said I had proof that Sept. payment was cashed already by TBW with Colonial Bank Orlando, Fla stamp on the back. The rep said that "unfortunatly" if I could fax a copy of the cancelled check to "payments research" that it would be credited. I then went in person to a Bof A branch and repaid Octobers payment and also had them fax the same copy again just to be safe.I also mailed a copy. I waited 2 days and called B of A again and was told that the payment I had made, was allocated for Sept. Eventhought Each check is clearly marked for what month. I proceeded to tell the rep that I had faxed proof of the calncelled check and was there any info on this.. The rep said that I was misinformed and it didnt matter if I had proof I would have to wait until aprox 30-60 fdays for everything to be allocated. I asked to speak to a manager who inturn was as unhelpful as all the rest had been.

Since Oct 1st is coming up quickly I made a payent again over the phone and was givin a confirmation number. She said she would waive the 20 fee this time to pay by phone. Can you beleive this? I asked her what was I suppose to do if I didnt have the money to pay again? With no empathy I was reminded how thousands of others were in my same position and I did have a 60 day grace period. It gets better. My homeowners insurance naturally wasnt paid either and would be cancelled OCT 3rd. This was also in escrow. I was on a conference call with my insurance company and B of A. The B of A rep tried everything not to take the information to correct this and tried to push me on the website to do it myself. Oh and by the way,the website doesnt recognize my loan number. I know 30-60 days grace period. The rep even tried to say that they didnt do escow eccounts fo my insurance compay. Unfortunatly for him I am an insurance agent myself and work for an extremely honorable company. basically i feel that I have had my 1400 dollars hijacked from my family in these hard economic times. We try to be responsible and do the right thing by not only being on time and even ahead by a month for security. Im a cancer survivor and I dont need this stress. If I had numbly just accepted what the original letter had said and not taken the responsiblity to make those calls I probably would have received some not so nice letters in 30 to 60 days.
