Class Action Filed

Brooke of Lincoln , CA September 14, 2009

I have been trying for a year now to modify my mortgage with WaMu talking to various individuals there that have been extremely rude. Insulting me and handling the matter at hand very unprofessionally; hanging up on my, raising their voices, etc.

Today I called once again to resolve the issue and talked to Dan and he was exteremly rude throughout the whole conversation. Wouldnt let me talk and blatantly insulted me and the situation I am in. I am beyond frustrated that WaMu is able to treat their customers this way. I asked to talk to a manager and was refused. I just wish that something can be done to address this since WaMu obviously allows their employees to treat their customers this way.

Pat of Edmond, OK August 17, 2009

In mid-January 2009, we applied to refinance with our current mortgage holder, WAMU. It is now August 17, and we have yet to close. We have excellent credit (800+) and the house appraised for well over the loan amount. We have been trying to contact someone on the status, but have gone through several processors and then been told we are close for months now.

Our current processor is Jordan E. He was initially very responsive, but we have not received any response to numerous e-mails for several weeks. Jennifer W was our previous processor, and she never replied to any phone call or e-mail over several months. We are concerned we may have lost the opportunity for the 4.5% rate due to their delays. There were no problems in any way with our loan and we responded to any requests for info. within 24 hours. Do we have any recourse? Thank you.

Sue of Campbell, CA July 27, 2009

I was solicited by Wamu/Chase by mail offering me to bundle my two loans, cash out, and all my bills paid. This offer was too good to be true and that should have been my initial tip off. After spending 1500 non refundable fee and discussing my credit history, including two late payments due to the bank holding a deposit for an additional 9 days which caused automatic payments to fail, I was told that if my house appraised for 700,000.00, that my refinance would be approved at 4.5%.

The house appraised for 700,000.00 6 months later, and on July 20th I was declined for reasons discussed at my initial meeting before I wrote the nonrefundable check. The bank literally threw my agent under the bus, stating she should have never approved it. I don't know if she is incompetent, the bank is fraudulent, or if this is just the luck of the draw.

I filed for borrowers assitance program from the WaMu website form first week of May 2009 to avail Barracks Obama's plan to help me to modify my loan due to hardships. I have not missed any mortgage payment yet but we are having financial difficulties so I decided to file for help. So I completed the form and send all the required documents on the check list. I was just told after several follow up that my case has not been reviewed yet and it takes time for them to assigned it. While waiting to hear from them, I received a letter from WaMu dated May 27,2009 that they need additional information to process my request. So I promptly send all the additional documentations on the check list.

On July 14 I followed up my case and I was been told to call back on July 17,2009 since there was still nobody assigned on my case yet.On that day, July 17,2009 I spoked to the staff of WaMu and instructed to go to a website to complete a application. When I asked her if they received the additional documents they requested on May 27 letter she said yes and enumerated to me the said documents. Also I asked if she was assigned to process my case,She said no at the time.So we end up the conversation and went to check the website I was been told.

I was so frustrated when I found out that the application is about the same as the one I sent on May 2009, with the same documents needed. To my dismayed I called back WaMu to clarify about that. I spoked to different staff this time and was told to fill up and complete everything as a new application. I strongly commented if they are trying to do run around on me. I asked about what happened to the 1 inch thick of document I sent. She then told me that the application they want me to complete is a new one that came out on May 2009. Also she stated on threatening sound that " Sir,Do you want to do it or not"?That if I want my case to be process I have to complete it or they will not look in to my case.

I was so upset that I requested to speak to supervisor so she hold me for about 10 minutes then was told that the supervisor is out of lunch ( the time was is at 0230 pm -Pacific time ). I said to her also, that I got a letter form WaMu dated May 27,2009 and did not said anything to complete a new form but only to send some misssing documents which they already received. Then she said that nothing can be done till I send the new application with documentations.I felt that even if I sent a new set of application and documents, what is the guarantee that they will process it in time and will not ask for an update documents by the time they a look on my case. This is really a waste of time. Now Im thinking to see a lawyer to do my modification for me.

My father bought our home 44 years ago and left it to me when he pastd. This is the first time owning a home. when I first found out my home went into foreclosure I called my lender WaMu they gave me a number to a modification agency in New York. So I called them and paid 4000.00 then to find out they never helped me I called for my refund and couldnt get anyone to answer my calls. I did every thing in my power to get WaMu on the phone for help with modification but all I got was the run around. Anyone can see I would do what ever it took to save my home of 44 years WaMu sold my home at a trustee sale in fact they bought it back. ALL I WANT IS TO KEEP MY HOME WITH A LOW PAYMENT. MY PAYMENT NOW IS OVER 2000.00 WHAT CAN I DO?

Fred of Montrose, CO July 9, 2009

I hope Washington Mutual and Chase Bank, which I understand took over WM are not receiving any help from the government for supposedly helping people who have negative amortizing loans with them about to go into default. I spent a great deal of time to send in any and all information requested on behalf of my son to try and help him get a modification of his loan as the fair market value of the place is less than the loan he took out that has gone up by nearly 25,000!:( I even sent them comps and all kinds of information to help and all we got back was a form letter saying we did not provide adequate information!? No one knows what they are doing over there and they have no interest, whatsoever, in helping people. Son will probably lose his home as there have been 7 foreclosure in his complex.

MaryTate of Ford, WA June 15, 2009

We applied for a loan modification in March "09, We received a letter dated Apr. 9 saying that they needed more information. We faxed that info to them on Apr.14, I have the transmission log.

On May 12 we received a letter saying that they were cancelling our request because of incomplete application. I called and spoke to Casey, he verified that they had received the infor and would email the manager to reopen. When we had not heard anything I called on June 14th, and spoke to D. Stacy, she said that they had not received the missing info in a timely manner and had shredded the application, Ifaxed that to them the day after I got the letter requesting it, what do they consider "timely"

For a month I thought that our request was being processed, now we have to start over, losing over a month of time, this is very stressful, especially since my husband has had both a stroke and heart attack in the past two years and needs to keep calm

Joanne of Needham Heights, MA June 10, 2009

We started a refinancing in March 2009 and paid a supposedly refundable at closing 750 fee. As of today, June 10, 2009 we have not closed on the refinancing and no one has returned a single phone call from us to tell us what is happening. I have called and left many many messages.

The last time we spoke with anyone was May 3, 2009. At which time we were told our rate would be kept at no cost to us since Wamu forgot to include credit line when initiating the refi in April, but we were told the refi would have to be done all over again and we would be at the bottom of the pile again, through no fault of ours.

Our credit is excellent (800 scores) and we have been a WAMU mortgage holder for years with no problems. We have not been able to enjoy the lower monthly payments for these last few months and it looks like we are out 750 for 4 months at least as well. What can we do?

Julie of Gibsonia, PA June 4, 2009

Started a mortgage refinance with our current lender, WaMu/Chase, back late February/March-2009. We are on our 4th loan processor, every time the loan file is handed off the file is "incomplete" and I need to provide the documentation - even though this documentation has been repeatedly sent in the past to the last processor (and the processor before that, etc). Rate lock has expired, and I have been unable to find a human at WaMu/Chase to talk to. Every contact number I have for them goes to a full voicemail box and disconnects me. Our current mortgage rate is good - 5.875 and we are 6.5 years into our 30-year loan. Our credit scores are good - around 800 and our house was appraised at 405K and our loan is only 215K. I am trying to take advantage of historically low rates, save myself a few hundred a month to help make our daycare payments for 3 children, now I'm out 850! Plus ***MONTHS*** of frustration. Out of pocket costs - 750 refinance application fee, 100 home equity subordination fee. Mortgage refinance was promised to close in early April, so have also "lost" about 225 worth of monthly mortgage savings (675 total).

Lori of anaheim, CA May 22, 2009

I started a refinance with WaMu in Feb 09, I was given 3 loan processors from Feb -May and still no completion. I wanted simply to get a lower rate on my home loan. I have been with this bank for over 20+ years. My credit is above 750 and loan to value was very good. I was unable to get a human on the phone, had to supply the same information numerous times and still no conclusion to this.

Every person I dealt with was simpathetic yet no one could expedite the loan nor give me a date as to when we would be finished. I was told I was approved and the loan was going to underwritting, then the next thing I know I have been sent again to a new processor and had to start over. They went beyond the commitment date and told me they would extend the agreement and yet tehy still could not give me a difinitive date of closing.

I lost the current lower rate, my blood pressure is through the roof and now I have to start over and will probably have to fight to be reimbursed my loan application money. Not to mention that the home values are still plummeting and I will probably appraise lower now on my home.
