Maybe Sleepy's needs to wake up. The chain spends big bucks on hard-sell advertising to get customers in the door but doesn't do much to make them come back to do anything other than complain. A lawsuit by the New Jersey Attorney General doesn't do much for the chain's image, either.

Here's what the company suggests:

My name is Melissa and I am a Customer Relations Representative at Sleepy's Inc. It has been brought to our attention that you filed a complaint online and we would like to offer assistance to you. I understand this is a public website and ask that you contact me directly at customerrelations@sleepys.com and provide your account information so we may further address your situation.

We look forward to hearing from you, so we may expedite resolution to your situation.

What Can You Do?

If you have problems similar to recounted here, the first step is to write a factual letter to Sleepy's, outlining the specific problem and the steps you have taken to resolve it. Leave out the name-calling; be firm but polite. Then, propose a fair solution and set a deadline of 30 days, after which you say you will take other action.

Send the letter via certified mail, return receipt requested. Keep a copy of the letter, the receipt that proves Sleepy's received it and copies of all your invoices, credit card slips, etc.

If Sleepy's does not respond and resolve the problem, you can try any of the following:

  • File a ConsumerAffairs.Com complaint. Companies hate seeing complaints on our site and will often try to resolve them. Also, complaints filed with us are reviewed by class action attorneys for possible legal action.
  • File a complaint with your state, county or city Consumer Affairs Division. You can find them in our Consumer Resource Directory.
  • Sue Sleepy's in Small Claims Court. This isn't as drastic as it sounds. It is inexpensive and you don't need a lawyer.
  • Ask your attorney to handle it. This is the most expensive option but if you value your time highly and can afford it, it may be the quickest and most effortless.

On 9/25/08 I picked up a queensize Miralux Splendor on special for 699 - a savings of 900. I had come to the store twice to try out mattress for comfort with floor model before deciding to buy it. By 10/26/08 the mattress made me feel progressively worse, finally numbness in both hands and sore teeth made me stop sleeping on it. I called the store several times, even stopped by - they told me I had to deal with 800sleepys.

They refused to exchange or accept return and told me I should donate it to charity and buy another mattress. they could offer me discount (no refund - that is in addition to the initial cost). The next time when I said I would complain, I was told You do what you need to do but we are NOT taking it back. Is there anything else?

Pain and sleep deprivation - I am still trying to recover from the physical damage from sleeping on the Sleepy's mattress set.

Purchased our SERTA king size bed from SLEEPY'S January 2007. We purchased: matress, box spring, bed frame, and head board. Total cost: 1700.00. They gave us a 110.00 matress cover. After 4 months the bed began to squeek, and the box spring would fall between the frame and the screws holding the head board on began to fall off. I called they came out and fixed the head board and gave us a new frame that fits a little better.

Now the matress squeeks more and is sagging. The inspector came out 2 times and measured took photos and on the report it has defective. Why I cannot get an even exchage............a small stain was found on the matress. When I told them I had the matress protector, they said oh well then it's covered. However, mine is NOT covered because I did not mail in the post card for the matress cover.!!!!!!!! If you have on your records that SLEEPY'S GAVE ME THE COVER I SHOULD BE COVERED. Well, now 5 months and 100's of calls later, I was told to go back to SLEEPY'S pick out another matress and they would give me a buy back credit.

After 3 visits to 2 different SLEEPY'S stores I was finally told my credit would be 400.00! After sleeping on a matress that cost 1200.00 for about 6 months their giving me 400.00! NOT EXCEPTABLE. I want a full refund for the matress and box spring.

My husband back since has been giving him problems. He is out of work and I cannot afford to spend another 800.00 on a matress after a year.

Bed has hundreds of bedbugs that bit me.

i have to a skin disease now, I itch all over. I had to but several bugspray. I threw away pillows, bedsheets. The bugs infested my bedrrom, bathrroom and living room. I am not able to use the bed. Sleepy's refuse to accept responsibility.

About a year and a half ago my fiance and I bought a tempurpedic from Sleepy's. I was very apprehensive in the store about buying such an expensive bed. They gave me the song and dance how great this bed will be and then they said 2 pillows, delivery, and the frame would be free. If I wasn't satisfied I had about 30 days to return it no questions asked. And I still wouldn't be charged for anything.

Within the thirty day period, my fiance and I were unsatisfied with the bed and sleepys came to pick up the mattress. A month later I got two bills in the mail. I had to finance through GE and Sleepys. I called them and they said it would be taken care of. GE stopped sending me bills. However, every month for the last year, year and a half, I have been getting a bill from Sleepys. I have called them repeatedly and they have told me that they will look into it and call me back. They have told me that they will get it taken care of.

In August I finally spoke with two different people. The last one I spoke with was Heather. She said that I had to pay for the pillows and the frame and the pick up charge for the bed. I told her that I was advised that i wasn't responsible for these things. She called me back and said that she would settle with me for like 240.00. I told her fine, I just wanted them off my back and I would take care of it. I asked her to send me a statement with proof of the agreement so I had a copy for my records. They never sent me a copy of that statement and sent me to a collection agency for the full amount. 679.49.

I called back and explained what happened and they have in their notes that I requested a copy of this, but Alicia told me that I wouldn't get another statement because it was sent to the collection agency. I said that it shouldn't have been turned over because of the agreement. I called back and spoke with a supervisor named Joanne and she told me that this was out of her hands and I could call their lawyer. I asked for statements and my notes out of their system and they told me it would have to be requested by a lawyer. I feel that this is harassment.

I tragically lost my fiance in the beginning of this year. So I am not sure what records I have and don't have. Please help me! My credit is being destroyed because of this nonsense. Which means everything I do, that deals with my credit, is going to go against me. I am 26. So I will be looking to buy a house and start my family.
