Feds Snuff Smoke Away Claims with $1.3 Million Penalty
Consumer complaints about Council on Natural Health and SmokeAway

"M" writes (6/1/02):
I called at my son's request to order "SmokeAway" advertised on TV. I authorized the purchase of SmokeAway. A pitch was made for Nulung, which I declined. The package arrived with an invoice for both SmokeAway and Nulung, with a letter saying Nulung was back-ordered and would ship May 15. 6/2 - has not arrived. I also received package for Credit Sense and American Health Protection, both Assurant Group. Did not authorize those memberships.

Credit card charged for Nulung although never authorized and never received. Had to call 3 phone numbers, wait on hold and listen to two aggressive pitches trying to convince me I was stupid for not continuing the memberships. I am still unsure what further charges may show up on my credit card.

On or about 10/23/02, I placed an order for "Smokeaway" based on a radio advertisement I heard while in Lawton, OK. I placed the initial order after answering several personal questions. Then the call taker pressured me into buying more products and memberships, all of which I declined. The more I declined, the more he persisted. This person was obviously frustrated with me to the point that he abruptly ended the call by hanging up on me.

The $96.90 was posted to my credit card, yet I have not received the product. I cannot locate anything about the company except a Consumer Affairs complaint on the same company from a woman in FL who experienced the same problem I did. I have been billed on my credit card since 10/24/02, and have not received any product.

Linda should immediately notify her credit card company that she wishes to dispute the charge.

Chad of Mishawaka IN (8/27/02):
My grandfather ordered some stop-smoking product from hearing it on Dr. Laura. So finally part of it arrives after 5 weeks or more. I guess from their conversation they were going to send out the rest. So ends up, they claim to have sent it out. Of course it never arrives, so they say too bad we sent it out. So we're out $100.

Kenneth of Jacksonville FL (10/21/02):
On 13 August 2002, I returned the Smoke Away kit to the company. It was received and signed for on 15 August 2002 at 0900 hours. My understanding when ordering the product was a guaranteed refund. To date, no refund, no correspondence on their part. My second letter to them requested the refund promised, or have the smoke away kit returned, I could at least sell it to someone else. No correspondence on their part concerning the matter/no refund.
