Mountainside Renovations

In August 2005, we decided that my parents should come and live with us but we were unable to accomdate them because of the size of my home. After much consideration, we decided to have an addition added on and proceeded to locate a builder. My husband found a company, who he said had a good reputation. They are Mountainside Renovations and Drywall. On or about August 20, 2005, we signed a contract for them to build the addition from start to finish. Mr. Colon boasted many times that they could and would finish before Christmas 2005. Up until this point we have been patient but we can no longer wait for him to come when he pleases.

He has disappeared with $115,00.00 of our money.

He did build the foundation, frame it, side it and put the windows in as well as the roof and some of the electric is done. The plumber finished his portion and has been calling Mr. Colon everyday for the past 2 weeks to get paid for the work he did. To our dismay, Mr. Colon hasn't called the plumber back who has now called us stating that because Mr. Colon refuses to return his call and pay him, he is going to the town today to have a Stop Work Order issued and possibly get a lien put on our property. It has now been more than 2 months since the contractor (Mr. Colon) has been to our house.

My parents have now sold their home with a closing date of approximately May 25, 2006. Once they close, I will have to squeeze them and their furniture in my unfunished house. I have lost the use of my downstairs bathroom and most of my kitchen because they closed that area off. They never moved my dining room window (they just took it out) and that is the least of the problems. In the beginning, before the foundation was done, the contractor failed to tarp it causing my basement to flood 2 or 3 times. He hasn't issued us any credit or submitted it to his insurance company. We let it go so that it wouldn't interfere with construction but we have now hit a brick wall. We cannot locate him because he moved and we only have his wife's cell phone and she no longer answers it. We don't know what to do!
