Liberty Mutual Sued in Bid-Rigging Investigation

I was hit by a vehicle on 3rd Feb 2009. Initially the insurance company stated that they would fix the car based on an independent adjuster's (hired by them) estimate of 2,293. I had gotten as estimate for approximately 3,400 to get the car fixed. When I went to the body shop with the estimate of 2,293 obtained from the independent adjuster, the body shop and adjuster went over the damage and came up with an additional 830 at which time the insurance company wanted to total the car. The offer they made was 2370. This is almost 100% the first estimate ( 2293) to fix the car - my question was why wasn't the car totaled then? I knew something was fishy. One of the pages in the independent adjuster report, lists the car value as 4,150 per NADA. Kelly blue book suggested retail value is (copy attached): Excellent - 5,785 Also,

Black book retail value report which varies from 6,475 to 3,200 depending on the condition. Exactly one year before the accident, I had spent 1900 to get the car in top condition. One day before the accident, I spent 250 dollars to replace the front wind shield. The insurance company is not giving any credit to these at all. One noteworthy point here is: When the adjuster first did an estimate, only 250 were deducted due to high mileage. However, when they decided to total the car, they deducted 1,271. They still havent given me a reasonable explanation for this.

I strongly believe I have been cheated in this regard. I have enclosed copies of these pages as well. I also sent links to several cars that are on sale around the area, varying anywhere from 7,000 to 4,000. They say they do not use Kelly Blue Book, NADA, Black Book which are widely used and respected, instead use their own adjuster's report. Considering all the above quotes, I am asking the insurance company for 4,000 or fix my car. The insurance company has also not fully reimbursed me for the rental. I had an out of pocket expense of 126. My car involved in the accident was a Nissan Maxima and I rented a Camry. Insurance Company says I rented a bigger car! I have 2 small kids with car seat, how do they expect me to fit it in a smaller car?

Charged for 4 cars (had 3), suppose to send check with credit my mail. When never received the check, told that credit was applied to the policy balance. Monthly payments went from 374 to 613 (over 1 month) to over 1000. When questioned the increase, told that changes were made to the policy but not able to explained waaht changes. Salesmen playing with words, not anwering questions, manager delgating and not following up nor returniong calls.

March 2007, Husband had accident while making a left turn where another car going striaght hit him although that car was behind another car in turning lane seemingly making a left turn in other direction. Driver apparently did not want to make this turn so he quickly swung around the car in front of him and ran the red light hitting husbands car. There was a reliable witness who testified to this yet Liberty Mutual charged my husband as being at fault and granted money to other party for car damage. Car was about a 1968 car!

Man was fine, seen talking to police officers at scene while my husband and his passenger were taken by ambulance to hospital. They thought my husband had broken neck and he spent over 24 hours in a collar immobilizing him causing great suffering since he has a neck conition. Despite this, we later found out that the other party was also suing for bodily injury and Liberty Mutual did nothing to help us. Case is presently in litigation due to lack of honesty and blatent dissregard for the testamony of the witness. Rates were doubled, bad enough but now, we just received new policy.

It is more then 1 1/2 years since any accidents or violations and premium went up by another 1200 and the only excuse was that NYS raised rates! 1200 a year! Thought rates would go down somewhat since records of all drivers have been good since around 1 1/2 years ago. Shame on this company, we never even recovered the loss on our car that was totalled and much newer then the other parties very old car. How can this country allow these insurance companies to just do whatever they want with no recourse for the consumer?

Economic disaster. Had to remove all but liability coverage on cars, 2 of which should still be covered, but cannot afford to. They really have you over a barrel with no possible resolution and no one really listening or investigating the real facts.

Ten years later, I found that Liberty Mutual had me in a higher tier for my car insurance. I had owned a jeep, but when I sold it 10 years ago, they failed to adjust my insurance and put me into the appropriate tier. When it was adjusted, due to my having them requote my insurance, my car insurance went down 1800 per year.

After 10 years I'm guessing I was overcharged by 15000 to 18000 dollars! I feel they knowingly left me in the wrong tier when they were notified to drop insurance on the Jeep and trade it for an older model S10 pick up truck. What do you think?

On December 4, 2008 I was hit by a Liberty Mutual insured. She had crossed 6 lanes of road (turning left out of a grocery store parking lot) to hit me. I had seen her make this wide turn, so to avoid her hitting me I switched from the middle to the far right lane (out of her way). She STILL hit me. She claimed she did not see me (i was the only car on the road). I filed the claim with Liberty Mutual and they said they needed to get an estimate and would contact me to set it up. No call ever came. I finally called them the next week.. having to give them most of the information again. They were nice enough to ask me when the best time to call is. I told them 9am-5pm. They called me at 8am the next day... why bother to ask me?

A month after the accident, the appraiser finally came out. They accepted 100% liability (i think that the lady who hit me admitted fault or else it probably wouldn't have been that easy). Got my car into the shop the following monday. It was fixed on Friday...couldn't be released because Liberty Mutual hasn't ok'd anything. Here I am a week after my car is fixed...still nothing.

Called Liberty Mutual, they told me that they would look into it. The car shop I deal with say that Liberty Mutual is notorious for delaying payment. Hmm... I guess anyway to avoid putting out the money (avoiding calling me when they say they will, avoid setting up an appraisal, avoid paying the car shop... pattern here? The other thing that irritates me is that my Claimes Representative has not been available one time in the last two months to take my call. If a company is going to give a contact name for a client to CONTACT, they might want to make sure that CONTACT is going to be available at least sometime!
