Dating Service Faces Break-Up |

The lawsuit, filed in February 2004, is seeking over $1.1 million in consumer restitution, fines, and civil penalties from the dating service for 101 alleged violations of the Kansas Consumer Protection Act and four alleged violations of the Kansas No-Call Act. In an order issued December 16, 2004, the court found that "it appears that violations of the Kansas Consumer Protection Act have been or are being or are likely to be committed by the Defendants" including unconscionable conduct as defined by the KCPA. The Order applies only to the Overland Park office because the Wichita office filed for bankruptcy last year and is no longer operating. The court determined that Great Expectations in Overland Park could continue operating while litigation is pending, but only on the condition that they make audio recordings of all sales interviews and provide copies of the interviews daily to the Sedgwick County District Attorney's office for review. The court is also requiring the company to provide a written notice to potential clients advising them that the law usually binds people to the written terms of a contract and that any conversation that occurs before the contract is signed cannot be used later to change the terms of the contract. The lawsuit was filed last year by Kline after his office received complaints about the service from two Kansas consumers. Since the filing, Kline's Consumer Protection and Antitrust Division has received more than 80 additional complaints by consumers. Report Your Experience
