"Factor" Promoters to Pay $1 Million

Douglas of Groveport OH (12/14/07)
I asked for the Free Trial and was told I was going to pay for shipping only, which did happen. Only to find another bottle of this JUNK in my mailbox, which I did not order. When I called to complain, I was told there was an automatic re-order every month charged at $59.95. I promptly returned the UNOPENED bottle for a full refund as stated by the customer service. I have yet to receive a refund. This product did nothing for me, I believe this is the biggest SCAM ever!

Cathie of Mount Morris MI (02/27/06)
My sons Dr. recommended this free trial for my son ADHD called Focus Factor. I called the toll free number for free product pay only $4.95 shipping. I explained I do not want any additional charges only free bottle. After a lengthy sales pitch. I told them no auto bill just one time trial, nothing more. I hung up the phone and then proceeded to read numerous complaints about this company sending product time and again and billing charge card continously.

I immediately called company back and told them I what I had read about them and again I stated I do not want any more charges on my bill than the shipping charge of $4.95. The woman told me no problem Sarah 1-800-611-5101. Just to make sure I was getting my point across I called back again at 1-800-825-1423 and I talked ot Trina who reassurred me I would not be billed any more than the shipping of $4.95. I mentioned I was fearful that they would charge me again due to numerous complaints on the internet. She told me I would not be billed. I told her I do not want this product again.

I received free bottle on 2/5-06 and received two bottles on 2-27-06 with an invoice billing my charge card $159 for 2 more bottles of this Focus Factor that I did not order. I was beyond livid. I called them 2 times on the same day of transaction stating over and over I do not want this product again. I only want to try free bottle. Period. Then my credit card is billed $159.90.

Luci of Oceanside CA (05/22/05)
Back in June 15,2004 I received a free bottle of Focus Factor. After taking the product I did not like it. I called in for cancellation. Instead of charging $4.95 only they have charged my account $159.85. I have never received any products from them besides the first free botlle. In June 17 2004 my mother-in-law died and I completly forgot to check for the refund, I found out today that the money has never been refunded to my credit card account. I have just sent a letter to them.

Nathan Vancouver WA (04/30/05)
I called to cancel my order, it has been more than a reasonable amount of time and they have yet to credit my card.

Bland of Lewistown PA (04/21/05)
I received a sample of "Focus" in the mail, which I promptly threw in the trash and forgot about it. Today, some weeks later I received a bottle of this which I am expected to pay for. Since I didn't order it and don't want it, am I obligated to pay for it? I smell a racket going on here and expect a package will show up every month.

Julie of Jacksonville FL (03/17/05)
I stupidly ordered their "trial" product over the phone. I was to have until 3/18/05 to call and cancel any future orders (Focus Factor and Omega 3) 3/16/05 - I checked my checking acct. on-line and saw the balance was much less than it was supposed to be and checked further. I found they'd already placed a "hold on funds" for date 3/18. This was going to make other checks bounce.

I called and got Robert on 3/16/05 and he said the "systems were down" and to call back in a hr. I told him I wanted the "hold released immediately and the orders cancelled". ROBERT ALSO STATED THAT IF I INCURRED OVERDRAFT CHARGES THEY'D REIMBURSE ME! I called back later that day and got Jeff who said "it'd mailed already and they couldn't stop it. I explained I was to have had until 3/18 - was calling 2 days earlier - wanted the funds hold released. He put me on hold - checked w/Supv. (supposedly) - and said he'd gotten permission to cancel the order - gave me a return #RMA 8814129 to return the product. He "said he'd process a credit back to my account" but it'd take 72 hours to hit my bank.

In the meantime I'd been in touch with my bank and they said I'd have to dispute it as soon as the charge hit - that they couldn't put a "hold" on the draft request. They gave me the dispute form.

Jerry of Santa Clara CA (03/16/05)
Approximately one year ago (I'm not exactly sure) I ordered Vital Basic's FREE TRIAL Focus Factor. It was sent to me along with another bottle of some other product to try also & I was told that I had a certain aqmount of time to cancel the order that they would automatically put me on so I wouldn't be charged anything. I called well within their Time Period & said I didn't want anything however they had already charged my CC account well over $300.00 which I most definitely had not planned for & had not authorized.

I then called them up, chewed them out & Demanded that my Credit Card be IMMEDIATELY credited. They tried to give me a run-aropund, but I wouldn't stand for it & let them know I would contact my local TV Ombudsman, State & Federal Legislators, etc. My money was credited back. HOWEVER, tonight I checked my online bvanking & found that Vital Basics had arbitrarily charged my account on March 4th 2005 $34.95 which has me fuming... How on Earth do they think they can get away with this Thievery?

I'll bet they have done this to probably thousands of people nationwide figuring no one will notice & they will make through their Fraudulent Withdrawals Millions of Dollars. The U.S. Government should hold this company Executives & the company itself under RICCO Violations for Organized Crime & put them out of business.

Jason of Columbia SC (02/22/05)
Upon receiving a offer in the mail I wanted to try focus factor. The deal was I was only to be charged 4.99 for shipping and handling and nothing else would be charge for 30 days for a free trail period. This Focus factor does not even work so I was going to call and say that I did not want to continue our business althought to 2-22-05 I have to get my lights turned on in my new apartment althought I can't becuase here we are two weeks later and they have charged my account just about 200 dollars for these pills that don't work.

I can not get electricity turned on in a apartment becuase my account has been abuse by Vital Basics.

Maria of Hialeah Gardens FL (12/14/04)
I saw the Tv commercial for focus factor and it said that you could try it risk free for only $4.95 for shipping costs only. So I agreed to pay for the shipping costs and recieved the product. As soon as I recieved the product, i realized that the pills were to large and u had to take too many a day so I didnt even begin taking them. I called customer service immediatly and cancelled the additional shipments. They agreed after giving me a huge sales pitch.

But ever since 7/2003 I've been getting charged 34.95 everymonth on my credit card after I cancelled which makes a total of 174.75 of charges so far! I have not recieved another bottle again! Ive called for them to stop charging my acount but nothing. I have finally sent hem a certified letter but have had no response yet.

Betty of Studio City CA (12/02/04)
I too called and asked for trial bottle of Vital Basic's Focus Factor. I received the bottle, but, as well, each month another bottle was sent to me and billed on my credit card. I did not order any product. I had previously been a customer of Vital Basic and ordered the product Focus Factor shipped to me, but in larger quantity (six per shipment). I called and explained this and the shipments and billings immediately stopped. (I informed them that I already WAS a customer.) I as well understood I was being stolen from by this billing and shipping of this product.

Byron of Houston TX (11/05/04)
September 4, 2003 Vital Basics charged us $4.95 on our credit card for a sample bottle of Focus Factor. On October 8, 2003, they charged $199.95 to our credit card and we never received any merchandise. Now we find a charge of $34.95 on October 18, 2004, a year later and we have not ordered any merchandise.

Jodi of Oregon OH (08/24/04)
I had ordered some of the vitamins quite a few months ago and last month I had called them and cancelled my order. Last week they charged my account $159.00 and sent me more. I called them back to demand my money back and find out why they had charged my account again. The woman I talked to on the phone said that it is in the computer to cancel my orders and she did not know why they did it again, but if I sent the product back I could get a refund. I went on the internet today to check my account and they again charged my account another $35.00.

Ramon of Springfield VA (08/15/04)
I just got a billing through my credit card $249.95 wherein I never placed this order. I am now trying to dispute this. I did try their product last year
but I canceled and did not proceed with the purchase. I just wanted the free sample.
Thank you.

Deanna of Anoka MN (07/25/04)
Icalled and ordered and paid the 4.95 for shipping and then they said i could cancel it and pay nothing but for the last couple months they have been taking out 24.95 and my account has been bouncing and they aren't sending anything. I would lkie them to quit taking money out and I never want the product again. i called the bank and they said they will take care of it so I hope this matter gets resolved.

Luhra of Union NJ (07/21/04)
I was sucked into an advertisement for a product called "Focus Factor". They claimed gain in memory and function. As a student, I assumed this would be beneficial. In reality, I think Focus Factor had some type of Omega 3 vitamin (so claimed) that I can easily get from eating frozen fish. The product did nothing. I believe it was mind over matter. My trial period was for 2 weeks. I would be charged the shipping/handling of $4.95 and if I wished to cancel and not be automatically enrolled in their membership I would have to cancel within 14 days. Which is what I did.

They then proceeded to charge my credit card $34.95 for being a member which I did I had cancelled for within the 2 weeks of purchase. When i called their Customer SErvice line the representative kept repeating herself and not listening to what I was saying. It got to the point where I had to be rude and demanding of my request. After going back and forth, she finally said she will "refund my credit card within 72 hours". I will respond with a second part of my complaint if this refund is completed.

William of St James NY (06/17/04)
I was told that I could cancel at any time and my credit would be returned to the card. It has not happened although i cancelled months ago. I continue to get shipments and billed every month or so. I returned an unopened package today.

Bobby of Albuquerque NM (06/14/04)
Ordered free vitamins for $3.95 S&H. I received membership in V8 Omega Plan. I canceled on 04/23/04 and their records show it. Un-authored deduction of $299.95 was made from my checking account on 06/03/04.

I am a disabled Vietnam veteran. Sole income is from Veterans Disability Pension. I desperately need that money to live on. Every penny counts.

Ruben of Morgan Hill CA (06/03/04)
While driving to the store I heard over the radio a product by the name of Focus Factor being advertised to help you with your memory. I am a senior citizen and I decided to give it a try being you could get a free bottle to try it. On 4-20-04 I called Vital basics Inc, and placed an order for a trial bottle, they said I had to pay $4.95 for shipping so I gave them my Visa debit card number to pay for the shipping. They told me I had a month to make my decision if I wanted to reorder.

On 4-25-04 I received a bottle of Focus factor with a welcome letter from the president of the company Rob Graham telling me that I was being enrolled in the prefered Customer Club in order to buy other vitamins at a discount and that I will be receiving the next shipment in 3 or 4 weeks. On 5-11-04 I called them and told them that I was not going to order any more because I did not see any difference with my memory.

They told me there was another order coming to me. I told them I did not want it. On 5-12-04 They charged to my account $299.95, $159.85 and $24.95. On 5-13-04 I called them and told them I had sent the package back to credit my account. I received a credit for $299.95 but the still owe me $184.80. I called them back and they told me it was going to be a while because the company was filing Chapter 11.

I feel what they did is something close to fraud. I did not authorize this charges against my debit card, also the charges were made after I told them I did not want the Focus Factor. I closed my debit card account because I was afraid I was going to get more charges against my account.

Ginny of Tyler TX (05/30/04)
I returned a box of the Focus Factor vitamins, valued at $156.85 which was taken from my acct. I didn't open them. They weren't working. Also, I asked them to cancel my account for which they were deducting 29.99 a month for other services and products. I called on Tuesday, May 25, and the lady told me they had not received my package. It also contained a letter telling them to cancel my entire acct. It was shipped to them at least six weeks ago. I had also emailed them. What can I do? She wasn't any help at all. She didn't even sound trained with the appropriate answers. She only said she would note that on my account. She didn't help at all.

The 156.85 hasn't been added back to my checking account after I mailed the vitamins back even though I didn't even open them. All I did was relabel the package to be shipped back through the postoffice because it came from ups.

Rose of Winter Garden FL (05/19/04)
I got the Focus Factor for a free thirty day trial. I wrote to them and told them to discontinue any further shipments as the pills gave me intestinal problems. I have not recieved any more but twice my checking account has been debited for $34.95 from Vital Basics.

Neil of Las Cruces NM (10/5/04):
As a struggling student, my life is defined by a search for two things: (1) a way to stay focused--balancing college, family, and work are difficult, and (2) a good bargain. When I saw the TV infomercial for FOCUS FACTOR, I was more than happy to have my credit card charged for only $4.95. Much to my dismay, however, the product did not improve my concentration or focus one iota. Nor was it in any way a good deal.

Being what I thought was a smart shopper, I immediately made the obligatory "membership cancel" call after receiving the sample box of FOCUS FACTOR. The rep I spoke with assured me that I would be removed from any involvement with the company, and could expect that no further charges would be made against my bank account. One month later--and man, I should've expected this--I receive another box in the mail. This time it contains not one but three bottles of this overpriced multivitamin!

I was outraged, and called the company's customer service number. The rep informed me that my membership with vital basics had been canceled, but that I had been enrolled in their "automatic shipping" program (this must be my lucky day). She told me that I had not elected specifically to cancel *this* membership, and so the charge of 159.85 was officially authorized by me. After a lengthy, concise explanation of what I wanted done, the rep assured my involvement with her company would be completely terminated. In addition, and only after demanding that my money be refunded, the rep agreed to refund my money within 72 "business hours" of her recieving the box of vitamins.

First my boyfriend orded the vitamins for memory and concentration for just a $4.95 shipping charge. They said you could call and cancel at any time, they would also send you your next shipment automatically, which was at the most supposed to be 2 bottles, which would mean $150.00. Well I called 9 days after receiving the product to cancel and they told me the new shipment had already been sent out. I was upset and told them I did not want the product. They then told me to send the product back and they would replace the money in my account.

Then I go on the computer the next day to reconcile my check book and "BAM" I am seeing not one but two transactions on the same day one for $159.85 and the second one was for $299.95, that is a total of $495.80 plus over $150.00 in over draft charges. Well at this time I am ready to hit the fan. I try to call the company and of course it is closed, so I call my bank and now we have to conduct a fraud case against them, cancel our card and whatever else comes along with that. Nice huh.

This **** is supposed to help us but in the end it is just causing us more stress than anything. I am ready to have a breakdown over all of this.

Jennifer of Shreveport LA (5/1/04):
About a month ago I responded to the ad on TV by the makers of Focus Factor, offering to send me a free bottle of Focus Factor--I would pay only $4.95 S&H. I ordered 2, one for myself and another for my mom in Tyler, TX. As soon as my Mom received her bottle, she called me stating that she had just seen an expose' on their local news channel concerning Vital Basics. She said that countless people were claiming to have been charged repeatedly by Vital Basics, after the origional $4.95 charge.

Though I was a little concerned, my purchase had gone fine so I didn't lose any sleep over it ... until it happened to me! Sure enough, the following month, I started seeing unauthorized charges in amounts of: $139.95, $159.85, $16.95. I will never be that stupid again. My truck note is now past due because I can't access my own money until this whole thing is settled! What a disaster!
