Vicky of Huguenot NY (12/12/03):
I bought a Pug puppy from Candace Dempsy on 2-15-03. I paid $750.00 for the puppy. The puppy is now 13 months old (born on November 7 02) I have a contract stating that the puppy would be AKC registered. After multiple emails and phone calls I continue to be ignored and still do not have papers for the dog. My husband picked up the puppy and signed the contract that stated the papers would be closed registration, however, after speaking to Candice myself, she agreed to leave the papers open knowing that I had planned on having a litter.

I have an email printout in which she stated that the papers would be open. I have tried to contact her on more then one occasion. Each time either ignored or given an excuse as to why the papers were not in.

Damage Resulting: I have lost $750.00 that I paid for an AKC registered dog that does not have papers. I would have been able to breed her once but couldn't because she doesn't have papers. Her second heat was in October. I lost the money I would have been able to make on the litter if I had bred and sold the puppies. I don't know if the email is a legal document or would help in court but the contract still states closed papers.

Vicky could indeed use the emails in Small Claims Court, which is where she should plead her case.
