Included
in retail installment sales contracts, such as contract to purchase
an automobile, are amounts reportedly paid to others, for example
extended service contracts and/or life, health, accident, or
unemployment insurance.
The
car dealership often fails to report that it is retaining
or is repaid a portion of this amount. This is called an "upcharge".
Failure
of the dealership to disclose that it is retaining a portion
of the amount paid to others is a violation of the federal
Truth In Lending Act and the consumer protection laws of some
states. Send us a copy
of your contract, and we will inform you if such a violation
exists in your contract.
